Poland – Wells construction work – Budowa ujęcia SUW Święcice

The subject of the contract is the execution and equipping of one operational reconnaissance-exploitation well OI-1 on the land plot ev. nr 249/2 in Święcice, Ożarów Mazowiecki municipality.

The detailed description of the scope of the contract subject is contained in the Contract Subject Description – Annex No. 1 to the SWZ, which consists of: 1) Geological Works Project, 2) Technical Specification for the Execution and Acceptance of Construction Works, 3) Work Scope. The Contractor is obligated to verify the work scope (it is only an auxiliary material). The work scope is subordinate to the documentation mentioned in points 4.4.1) and 4.4.2) of the SWZ. The offer should be prepared based on the attached documentation. The work scope does not form the basis for calculating the final offer price in the offer.

The scope of the contract subject also includes: 1) geodetic service within the scope necessary for the implementation of the contract subject, 2) execution of post-construction geodetic documentation, 3) obtaining a permit for use and handing over the ready object to the Contracting Authority for use along with the documentation containing certificates, approvals, or certificates necessary to commence exploitation, 4) and all elements mentioned in any part of the documents constituting Annex No. 1 to this Specification of Contract Terms (SWZ), which affect the offer price of the contract subject.

The Contracting Authority does not have a water law permit. It will be the Contractor's obligation to prepare all documentation allowing the intake and water intake to be commissioned.

The Contracting Authority envisages the possibility of alternative works and the conditions under which these changes may be introduced for technological, economic reasons, if the introduction of alternative works is necessary for the proper execution of the contract and does not result in an extension of the contract subject in relation to the subject specified in the SWZ and resulting from the content of the SWZ. The conditions regarding the scope of alternative works and the method of their settlement are described in § 15 of the contract template. The Contracting Authority will inform the Contractor of any changes during the execution of the contract. The performance of alternative works requires a change in the contract in the form of an annex to the contract, specified in Article 455 of the Pzp Act.

The Contracting Authority, in accordance with Article 95 of the Pzp Act, requires the Contractor or Subcontractor to employ persons performing the activities indicated by the Contracting Authority in the scope of contract implementation, if the performance of these activities involves performing work in the manner specified in Article 22 § 1 of the Labour Code of 26 June 1974 (Journal of Laws of 2025, item 277 as amended). The requirements for employment by the Contractor or Subcontractor based on an employment relationship concerning persons performing directly on the construction site construction works, i.e., physical workers and lower-level technical workers responsible for the organisation and implementation of construction works. These requirements do not apply to the construction manager, works managers, or persons providing services on the construction site within the framework of their own economic activity with the help of their own equipment or tools, such as measurement and testing work, demolition and earthworks, and the transport of construction materials, etc.

The method of verifying employment, as well as the Contracting Authority's entitlements in the scope of controlling the Contractor's compliance with the employment requirements and the sanctions for non-compliance with these requirements, have been indicated in the contract template, which is Annex No. 2 to the SWZ.
