Dismantling of the old Schwelme swimming pool

As part of the implementation of the new indoor swimming pool at the site of the former Schwelme swimming pool in Schwelm, the complete dismantling of the outdoor pool is required. The measure includes the demolition of the existing building and the outdoor pools.

I. Suitability criteria

1. Economic and financial suitability

a) Professional liability insurance, operational liability insurance, coverage of at least 5 million euros.

2. Technical suitability and capacity

Two references from the last three years (at least partially basement buildings with a gross volume of 1,200 m³ and demolition costs of the measure in the amount of at least 50,000 € net)

3. Legal suitability

Entry in the crafts register for demolition or civil engineering

II. Declarations of honour

The following declarations of honour, which you will find in the tender documents, must be completed and signed with the offer:

1) VHB Bund 124 "Declaration of honour on suitability"

2) VHB NRW 521 "Declaration of honour on grounds for exclusion"

3) VHB NRW 522 "Declaration of honour on Minimum Wage Act"

4) VHB NRW 523 EU Declaration of honour Sanctions Package (Russia) - Form (does not need to be signed)

5) Original calculation: only the best bidder must submit his original calculation before the award of the contract.

III. Review clause

The city of Schwelm reserves the right, pursuant to § 132 para. 2 No. 1 in conjunction with 132 para. 2 No. 4a GWB or pursuant to § 132 para. 2 No. 1 GWB, to offer the performance of the services to suitable bidders in the order of the tender result who have submitted an economically acceptable offer in the tendering procedure, if the contractor finally fails due to termination or for any other reason. In the event that the winner of the tender fails finally due to termination, insolvency or for any other reason before full performance, the contracting authority reserves the right to offer the remaining works to the other bidders in the order of the tender result up to place 5. The additional costs arising from this are to be borne by the previous contractor under the aspect of substitute performance. This only applies if the resulting increase in the total price remains within the framework prescribed by § 132 para. 3 GWB.

IV. Defence clause

These additional contract terms apply exclusively. The city of Schwelm only recognises contrary or deviating general terms and conditions of the contractor if the city of Schwelm expressly and in writing agrees to their validity. These additional contract terms also apply if the city of Schwelm accepts the delivery without reservation or pays for it in the knowledge of contrary or deviating general terms and conditions of the contractor.

V. Obligation Act (VerpflG, date of issue: 02.03.1974)

The Obligation Act applies to this invitation to tender. Accordingly, contractors of the public sector are obliged to fulfil their obligations conscientiously.

VI. Legal remedies (EU)

If we do not remedy a complaint, you have the possibility to submit an application to the competent tendering chamber within 15 calendar days (review application).
