Bulgaria – Cleaning and polishing products – ДОСТАВКА НА ПОЧИСТВАЩИ ПРЕПАРАТИ, НЕОБХОДИМИ ЗА ДЕЙНОСТТА НА „УМБАЛ ПРОФ. Д-Р СТОЯН КИРКОВИЧ“ АД

The subject of the public procurement is the selection of an executor for periodic deliveries of cleaning agents for the needs of „UMBAL Prof. Dr. Stroyan Kirkovich“ AD, hereinafter referred to as „stocks/articles“ or „cleaning products“. The procurement includes deliveries of goods, pre-announced and specified by type and quantity. The quantity of the announced goods is determined by the Contracting Authority depending on the specific needs and financial security. The quantities indicated in the documentation are forecast for the contract period and will be used to evaluate the offers. The public procurement is reserved under the meaning of Article 12, Paragraph 1 of the Public Procurement Act (ZOP) and is intended for the awarding to specialized enterprises or cooperatives of persons with disabilities or to economic entities, whose main goal is the social and professional integration of persons with disabilities or persons in a disadvantaged position, since in their subject matter are included deliveries of goods from the List of Goods and Services in accordance with the General Terminological Dictionary, adopted with RSM No. 591/18.07.2016. When the participants are specialized enterprises or cooperatives of persons with disabilities, the same must meet the conditions in Article 12, Paragraph 5 and 6 of the ZOP. To fulfill the condition, they can use subcontractors or refer to the capacity of third parties, if the subcontractors or third parties are specialized enterprises or cooperatives of persons with disabilities. According to Article 80, Paragraph 4 of the Public Procurement Act (PPZOP), there is no performance of activities with own production or resource, when specialized enterprises or cooperatives of persons with disabilities provide to the Contracting Authority without substantial additional processing goods, delivered by other persons. Other interested parties may participate in the public procurement, but their offers will be considered only if there are no admitted offers from the persons under Article 12, Paragraph 1 of the ZOP. The requirements that are intended for specialized enterprises or cooperatives of persons with disabilities do not apply to participants who are not specialized enterprises or cooperatives of persons with disabilities. The present public procurement by separate position No. 1 is „green“ and is in accordance with the National Action Plan for promoting „green“ public procurement, published on the website of the Public Procurement Agency (https://www2.aop.bg/) and with Ordinance No. N-1/23.07.2024 for the environmental requirements for certain products for the product group „Cleaning Agents and Accessories“. The Contracting Authority divides the subject of the procurement into two separate positions on the basis of Article 5 and Annex No. 3 to Ordinance No. N-1/23.07.2024 for the environmental requirements for certain products, subject of public procurement. According to Annex No. 3 the minimum mandatory share of the value of the contracts, in which the environmental requirements under Article 2 for the product group „Cleaning Agents and Accessories“ are applied, is as follows: at least 60% for the period from the entry into force of the Ordinance until 31.12.2026; at least 70% until 31.12.2028; and at least 80% until 31.12.2030. In order to comply with the legally established minimum requirement for the percentage share of „green“ public procurement within this product group, the Contracting Authority determines separate position No. 1 as a position in which the mandatory environmental requirements under Ordinance No. N-1/23.07.2024 are applied, including the criteria for hand soap and cleaning products. Separate position No. 2 includes products from the same product group, but for it the Contracting Authority does not set requirements under Article 2 and the following of Ordinance No. N-1/23.07.2024, thereby ensuring the possibility of achieving the required minimum percentage share of „green“ procurement for the reporting period, while complying with the principles of proportionality, free competition and efficiency in the expenditure of public funds. To prove compliance with the requirements in the technical specification of the Contracting Authority under separate position No. 1, Participants must submit a list of all the cleaning products and hand soap, which will be provided upon execution of the contract, as well as documentation proving their compliance with the minimum environmental requirements of Ordinance No. N-1/23.07.2024. For the cleaning products (degreaser and cleaner for sanitary ware) it should be proven that the criterion 1 regarding the toxicity to aquatic organisms and criterion 4 regarding the excluded and restricted substances from the criteria of the EU ecolabel for cleaning products for hard surfaces or equivalent/are met. Products that have been awarded the EU ecolabel for cleaning products for hard surfaces are considered compliant when the participant provides a document for the presence of the awarded mark. In the absence of an EU ecolabel, any other suitable evidence, including the manufacturer's technical documentation (specifications, safety data sheets, declarations of composition, etc.) or a test protocol from a conformity assessment body, will be accepted. For the hand soap in separate position No. 1, participants must provide evidence that the product meets the technical requirements of the EU ecolabel for rinse-off cosmetic products or equivalent. When the soap has an awarded mark for the EU ecolabel for rinse-off cosmetic products, it is accepted as compliant upon provision of a certificate, declaration or other official document certifying the awarded mark. In the absence of an EU ecolabel, other evidence, including the manufacturer's technical documentation or a test protocol from a conformity assessment body, will also be accepted. The quantities of the products indicated in the Technical Specification are forecast, and it is possible that they may be changed depending on the specific needs of the Contracting Authority. The Contracting Authority does not undertake to announce the forecast quantity of the products, subject of the present procurement.
