A sector dialogue and market survey have shown that currently, there is no high-performance gigabit infrastructure with an offer of corresponding telecommunications services available throughout the contracting authority in accordance with the goals of the Gigabit Framework Regulation 2.0, and it will not be available in the next few years. Therefore, the contracting authority has applied for funding for a comprehensive gigabit rollout in the viability gap funding model under the "Directive on the Promotion of the Gigabit Rollout of Telecommunications Networks in the Federal Republic of Germany - Federal Gigabit Directive 2.0 (Gigabit-RL 2.0)" of 31 March 2023 in the version of the 1st amendment of 30 April 2024 ("Gigabit Directive 2.0") and received the notification of the final amount of the grant. The funds provided in this funding programme in the viability gap funding model (hereinafter: funds) are to be passed on by contracting authorities to telecommunications undertakings in the sense of EU state aid law as investment cost subsidies for the construction and operation of gigabit networks. The same applies to the co-financing by the Free State of Bavaria in accordance with the directive of the Land of Bavaria.
