The subject of the contract is the reconstruction of the sanitary sewerage network and connections. The scope of the contract includes the construction of networks and connections with a total length of 749.14 m, including: a) Ø 200 mm PVC – 518.26 m, b) Ø 160 mm PVC – 230.88 m. 2. The detailed scope and description of the contract subject include: a) Technical and construction project: "Reconstruction and repair of the sanitary sewerage network and connections". b) Technical specifications for the execution and acceptance of construction works. The documentation mentioned in point 3.3 SWZ, hereinafter referred to as "project documentation" or "technical documentation", is an integral part of the SWZ and the contract template. 3. Important provisions related to the implementation of the contract subject. The contractor will be obliged to implement the contract subject under the following conditions: a) The contractor is obliged to execute the contract subject in accordance with the provisions of this SWZ, project documentation, Technical Specification for the Execution and Acceptance of Construction Works (STWiORB), contract project and applicable legal regulations, standards and technical knowledge rules. b) The contractor's offer must include all the costs necessary for the proper execution of the contract subject, in particular the costs of works, materials, transport, site security, obtaining the required decisions and permits, administrative fees, road occupation, geodetic service, post-construction geodetic inventory and restoration of the site to its original state. c) All materials necessary for the execution of the contract are provided by the contractor at their own cost. The materials must meet the requirements of the project documentation and STWiORB, and also have the required legal certificates, declarations of conformity, certificates and other documents allowing their use in construction. d) The contractor is obliged, before submitting an offer, to familiarise themselves with the documentation of the proceedings and to obtain all the information necessary for the proper preparation of the offer and execution of the contract. The risk arising from the inadequate recognition of the conditions for the implementation of the contract is borne by the contractor. e) The contractor bears all the costs related to the preparation and submission of the offer. f) The contractor is obliged to obtain all the required decisions, agreements and permits related to the implementation of the works, including decisions regarding the occupation of the road and the payment of related fees, in accordance with the applicable regulations. g) The contractor will provide, at their own cost, the geodetic service of the works and will carry out the post-construction geodetic inventory in accordance with the applicable regulations. h) The contractor is obliged to provide a quality guarantee for the construction works and materials incorporated for a period of 36 months, from the date of signing the final acceptance protocol of the works. i) After the completion of the works, the contractor will be obliged to tidy up the construction site, restore it to its original state and obtain written statements from the owners of the properties covered by the implementation of the works, confirming the absence of objections to the manner of tidying up the site and restoring it to its original state. j) The contractor is obliged to execute and hand over to the ordering party the post-construction documentation, within the scope specified in the contract template, which is an annex to the SWZ. k) The detailed rights and obligations of the contractor as well as the conditions for the implementation of the contract are specified in the contract project, which is an annex to this SWZ. 4. The ordering party informs that whenever the contract subject specified in the SWZ, project documentation and STWiORB is described by indicating a trademark, patent or origin, the ordering party allows equivalent solutions, i.e. those having features, technical and operational parameters, and application not worse than those described in the SWZ, project documentation and STWiORB. The proof of the equivalence of the offered subject lies with the contractor. In the event that the contractor intends to use equivalent materials or devices, they are obliged to attach to the offer a list of the offered equivalents together with characteristics and documents confirming their equal or better quality, e.g. quality specifications, quality control certificates, certificates, etc., which will confirm in an unambiguous manner the equivalence of the proposed materials or devices. 5.
