The subject of the contract is the preparation and conduct of training for road managers in the organisation of traffic on municipal roads in the area of 16 voivodeships. The description of the subject of the contract is contained in Annex No. 1 to SWZ. Due to the limited number of characters in the form for sending notices electronically, further information regarding the procedure is contained below (numbering transferred from SWZ): 5.1.4 The obligation of the entity providing resources to make the necessary resources available to it for the implementation of the given contract or other evidence confirming that the Contractor, when implementing the contract, will have the necessary resources of these entities, in the event that the Contractor relies on the capabilities or situation of the entities providing resources. 5.1.5 The obligation of the entity providing resources, as mentioned in point 5.1.4, confirms that the relationship linking the Contractor with the entity/ies providing resources guarantees real access to these resources and specifies in particular: - the scope of resources available to the Contractor from the entity providing resources; - the manner and period of making resources available to the Contractor and their use by the Contractor from the entity providing these resources when performing the contract; - whether and to what extent the entity providing resources, on the capabilities of which the Contractor relies in relation to the conditions of participation in the proceedings concerning education, professional qualifications or experience, will implement the contract/its part, which the indicated capabilities relate to. NOTICE - The Contractor is obliged to fulfil the information obligation provided for in Article 13 or Article 14 of the GDPR in respect of natural persons from whom personal data has been obtained directly or indirectly (in the case of using Subcontractors/Third Parties/Contractors forming part of a consortium) in order to apply for the award of the contract in this procedure. 5.1.6 A declaration from which it will result which parts of the contract will be performed by individual Contractors, in the case of Contractors jointly applying for the award of the contract and in relation to the conditions indicated in point 4.1.5 - prepared according to the pattern constituting Annex No. 5 to SWZ (if applicable). 5.1.7 A list of persons sent by the Contractor to implement the public contract, in particular those responsible for providing services together with information on professional qualifications, authorisations, experience and education necessary to perform the public contract, as well as the activities performed by them and information on the basis of their availability. The list should be prepared according to the pattern constituting Annex No. 7 to SWZ. NOTICE: The submission of lists, as mentioned in points 5.1.7 and 7.11 lit. e), results from Article 126(2) of the Act. The lists are necessary to ensure the proper conduct of the procedure, due to the criterion of assessing offers applied by the Contracting Authority, as the experience of the persons who will be sent to implement the contract, meeting the condition of participation in the procedure, the verification of which requires the assessment of both documents. 5.5 The Contractor entered in the official register of approved contractors or the Contractor certified by certifying entities meeting the requirements of European certification standards, instead of the evidential means, as mentioned in points 5.2.1.-5.2.3, may submit a certificate of entry in the official register issued by the competent authority or a certificate issued by the competent certifying entity of the country in which the Contractor has its registered office or place of residence, indicating the evidential means constituting the basis for entry or obtaining certification, unless the Contracting Authority has justified grounds for questioning the information resulting from the certificate or certificate. 5.6 The Contractor is not obliged to submit evidential means, as mentioned in Chapter 5 SWZ, if the Contracting Authority can obtain them using free and publicly available databases, in particular public registers within the meaning of the Act of 17 February 2005 on the computerisation of the activities of entities performing public tasks, hereinafter referred to as the "Act on computerisation", provided that the Contractor has indicated in the JEDZ data enabling access to these means. The Contractor is not obliged to submit evidential means which the Contracting Authority possesses, if the Contractor indicates these means and confirms their correctness and up-to-dateness. 5.7 The evidential means as well as documents or declarations drawn up in a foreign language must be submitted together with translations into Polish. If the evidential means, documents or declarations, as mentioned in Chapter 5 SWZ, are drawn up in a foreign language, the Contractor is obliged to present their translation into Polish. 7.11 The offer must include: a) FO drawn up and issued according to the pattern constituting Annex No. 6 to SWZ, in which, inter alia, the price should be indicated; b) a power of attorney or other document confirming the authorisation to represent the Contractor – if applicable; c) declarations and documents, as mentioned in point 5.1, with the reservation that documents, as mentioned in points 5.1.4 and 5.1.6 – if applicable; d) justification for the reservation of information contained in the offer as a business secret – if applicable; e) a list "Experience of persons sent to implement the contract", containing information allowing for an assessment in accordance with the criterion for assessing offers, specified in point 12.3. The list should be prepared according to the pattern constituting Annex No. 8 to SWZ. f) a document subject to assessment in accordance with the criteria indicated in point 12.4 SWZ, i.e. "Preliminary concept of conducting a two-day training", containing: a) the comprehensiveness and coherence of the concept; b) the diversity of activating and workshop methods; g) in the case of submitting a claim in a form other than monetary, the original of the claim document (guarantee or bond). 16.1 The projected provisions of the contract constitute Annex No. 2 to SWZ.
