The municipality of Frensdorf (hereinafter also "Lessor" or "Contracting Authority") is conducting a Europe-wide, transparent and non-discriminatory procedure for the award of a service concession in accordance with the provisions of Section 4 of the German Competition Act (GWB) and the German Act on the Award of Concessions (KonzVgV) for the selection of a network operator within the framework of the operator model according to No. 3.2 of the Gigabit Directive 2.0. Bidders must submit the required proof of eligibility with their offers. The Lessor reserves the right to negotiate with the bidders on their offers or to grant the respective first offer. The Lessor selects the most economically advantageous offer for the award based on the evaluation criteria mentioned under Section 8.2. The Contracting Authority reserves the right to cancel the procurement procedure in whole or in part if no economic result is achieved or if other substantive reasons preclude an award.
