The subject of the order is the repair service for a VOLVO FL FLB2C/VP vehicle. 2. CPV Code: 50114000-7 Services in the field of repair and maintenance of lorries 3. The procedure will be conducted without division into parts, since the order concerns only one unit of equipment, where the division of the order into parts is not justified. 4. A detailed description and the manner of implementing the order is contained in Annex No. 1 to the SWZ – „Description of the Subject of the Order”, which is an integral part of the SWZ. 1. This procedure is conducted in the form of an unrestricted tender, as referred to in Article 132 of the Act of 11 September 2019 – Public Procurement Law (Journal of Laws of 2019, item 2026, item 793) – hereinafter referred to as the „Pzp Act”. 2. The value of the order exceeds the EU thresholds specified in Article 3 of the Pzp Act. 3. The ordering party, pursuant to Article 138(4) of the Pzp Act, sets the deadline for submitting offers 5 days shorter than that specified in Article 138(1) of the Pzp Act, since the submission of offers takes place entirely using electronic communication means, in the manner specified in Article 63(1) of the Pzp Act. 4. The procedure is conducted in Polish, in electronic form via the Procurement Platform (hereinafter: the Platform) at: https://platformazakupowa.pl/transakcja/1323987 1. The ordering party, pursuant to Article 95(1) of the Act, requires the Contractor or subcontractor (if any) to employ, on the basis of an employment relationship, persons directly performing operational, repair and maintenance activities on the ordering party's vehicles, in accordance with the provisions of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2025, item 227), for the entire period of implementation of this order, as indicated in the contract template §8. 2. The requirements regarding the employment of the above-mentioned persons have been detailed in §8 - Annex No. 7 to the SWZ – „Draft Contract Terms”, and will then be included in the text of the future contract. Due to the Contractor's or subcontractor's failure to meet the requirement of employing persons performing the activities indicated in point 1 on the basis of an employment relationship, the ordering party provides for a penalty in the form of an obligation to pay a contractual penalty by the Contractor in the amount specified in § 14(3) lit. c) - Annex No. 7 to the SWZ – „Draft Contract Terms”, or the right to withdraw from the contract. 1. The ordering party does not reserve the right of personal performance by the contractor of the subject of the order, in connection with the above, the Contractor may entrust the performance of part of the order to a subcontractor. 2. The Contractor may not entrust a subcontractor with the full implementation of the order. 3. The Contractor is obliged to indicate in the offer, which is Annex No. 2 to the SWZ „Offer”, the part of the order which he intends to entrust to a subcontractor and the subcontractor's company – if known. 4. The ordering party requires that, before commencing the implementation of the order, the Contractor, if already known, provide the names, contact details and representatives of subcontractors involved in the implementation of the order. 5. The Contractor is obliged to provide the required information about new subcontractors, to whom he intends to entrust the implementation of the order at a later date. 6. The lack of information, as referred to in point 3, will be understood by the ordering party as the implementation of the order by the Contractor on its own. 7. If the ordering party finds that there are grounds for exclusion in relation to a given subcontractor, the Contractor will be obliged to replace that subcontractor or to refrain from entrusting the implementation of part of the order to that subcontractor. 8. If the Contractor does not intend to implement the order with the involvement of subcontractors, „not applicable” or a similar formulation should be entered in the forms. If the Contractor leaves the points in the forms unfilled (blank fields), the ordering party will assume that the order will be implemented by the Contractor's own forces, without the involvement of subcontractors. 9. Entrusting the implementation of part of the order to subcontractors does not release the Contractor from liability for the proper implementation of the subject of the order. 10. The subcontracting agreement may not contain provisions shaping the rights and obligations of the subcontractor, in the field of contractual penalties and provisions regarding the conditions of remuneration payment, in a manner less favourable to him than the rights and obligations of the contractor, shaped by the provisions of the agreement concluded between the ordering party and the contractor. 11. The Contractor will perform the services covered by the contract with its own forces. 12. The Contractor will be obliged to inform the ordering party about the subcontractor. All settlements between the Contractor and the subcontractor will take place without the participation of the ordering party. The ordering party does not allow partial invoices from subcontractors. 13. In the event of subcontracting services to a subcontractor, the Contractor undertakes to obtain the written consent of the ordering party for the entrustment of the implementation of part of the services to the subcontractor. 14. In the event of subcontracting services to a further subcontractor by the subcontractor, the Contractor undertakes to obtain the written consent of the ordering party for the entrustment of the implementation of part of the services to the further subcontractor by the subcontractor. 15. The Contractor, regardless of the conditions of his agreement with the subcontractor, is liable to the ordering party for the actions or omissions of subcontractors, as for his own actions or omissions. 16. The Contractor may not be released from liability to the ordering party on the grounds that the non-performance or improper performance of the contract by the Contractor was a consequence of the non-performance or improper performance of obligations to the Contractor by his cooperating parties, suppliers and subcontractors.
