Subject of the contract

Part 1: Sensory Park at Primary School 43, Porębskiego Street (BO 2020/MAK/0001). Development of the area at ul. Wiceadmirała Kazimierza Porębskiego 21. Winning project of the Citizens' Budget 2020/POD/0025 entitled "Sensory-recreational garden for the residents of the Pogórze district at ul. Porębskiego 21 on the territory of Primary School 43." Execution of a sensory park, the aim of which is to stimulate the senses: sight, touch and smell by creating thematic beds with a variety of species. Area of land development – 316m2. Mineral surface – 115 m2, Planned greenery material: shrubs – 30, perennials and grasses – 525, trees – 3. Bench with backrest and armrests. Maintenance – 36 months. (Annex 1a to SWZ - OPZ Part 1);

Part 2: Development of the green area of the bus loop at ul. Strzelców (BO 2024/POD/0025). Development of the green area – within the bus loop at ul. Strzelców in Gdynia. Winning project of the Citizens' Budget 2024/MAK/0001 entitled "Pocket park in the middle of the bus loop Mały Kack Strzelców". Area of land development – 44.9 m2. Planned greenery material: shrubs – 56, perennials – 192. Maintenance – 36 months. (Annex 1b to SWZ – OPZ Part 2);

Part 3: Development of the green area at ul. Chwarznieńska. Development of the green area along with 36-month maintenance along the streets: Chwarznieńska, Hodowlana and Rolnicza. In particular: removal of stones: 21 m³, turf removal with disposal: 2,723.2 m², establishment of lawn from seed: 125.5 m², planting of shrubs 4,454 pcs., perennials 8,484 pcs, trees: 75 pcs, mulching the area with bark with a thickness of 5 cm 2,723.2 m², fieldstone thickness layer 10 cm on an area of 11 m². Maintenance – 36 months. (Annex 1c to SWZ – OPZ Part 3);

The subject of the contract has been described in detail in Annex 1a, 1b, 1c to SWZ "Description of the Subject of the Contract" (hereinafter referred to as "OPZ") and the draft contract provisions constituting Annex 10 to SWZ. In the scope of Part 1 and Part 2, the Contractor is obliged to execute, deliver and install an information board containing data indicating the implementation of the task within the framework of the Citizens' Budget. Detailed provisions regarding the boards are contained in Annex 1a - OPZ Part 1 and Annex 1b – OPZ Part 2.

2. The Purchaser allows the submission of partial offers.

3. The Purchaser allows the submission of partial offers in accordance with the following provisions 3.1. The Purchaser allows the submission of partial offers for any selected parts of the subject of the contract. 3.2. The Purchaser decides on the procedure in favour of the most advantageous offer submitted for a given part of the procedure.

4. The Purchaser does not provide for the reimbursement of participation costs.

5. The Purchaser does not provide for settlements in foreign currencies. Settlements between the Contractor and the Purchaser will be made in Polish zlotys.

6. Subcontracting: 6.1. The Contractor may entrust the execution of part of the contract to a Subcontractor, on the terms specified in Annex 10 to SWZ (Draft contract provisions); 6.2. The Purchaser requires the Contractor to indicate in the offer, the part of the contract, the execution of which it intends to entrust to Subcontractors, and to provide the names of potential Subcontractors, if they are already known; 6.3. Entrusting the execution of part of the contract to Subcontractors does not release the Contractor from responsibility for the proper execution of this contract; 6.4. Detailed requirements regarding subcontracting have been specified in Annex 10 to SWZ (Draft contract provisions).

7. The Purchaser does not reserve the obligation of personal execution by the Contractor of key tasks related to the subject of the contract.

8. The Purchaser does not set requirements regarding the employment by the Contractor of persons referred to in art. 96 para. 2 point 2 of the Pzp Act.

9. Local vision. The Purchaser does not provide for the requirement for the Contractor to conduct a local vision or for the Contractor to verify the documents necessary for the implementation of the contract available on site with the Purchaser, at the stage of the procedure for awarding the public contract.

10. In the event of a discrepancy regarding the scope of the subject of the contract, between the SWZ and the Description of the Subject of the Contract, the provisions of the OPZ shall apply first.

11. The Purchaser informs that in this procedure, it does not use the possibility provided for in art. 16b para. 1 point 1 and 2 of the Pzp Act. Therefore, Contractors from third countries which are not parties to international agreements, nor Contractors jointly applying for the award of the contract with such Contractors, may not apply for the award of the contract. An offer submitted by a Contractor referred to in the previous sentence, or an offer submitted jointly with such a Contractor, shall be rejected on the basis of art. 226 para. 1 point 5a of the Pzp Act.
