Section 130a Paragraph 8 of the SGB V enables health insurance funds and pharmaceutical companies to conclude framework discount contracts for medicines to be dispensed at the expense of the statutory health insurance funds. With regard to the relevant legal provisions for the award of public contracts, a regular process of substance-related, formal tendering procedures according to the regulations of Part 4 of the GWB is carried out by the DAK-Gesundheit. For medicines to be specified by the bidder in more detail in Annex 2 to the contract for the aforementioned active substance Pomalidomid, ATC L04AX06, the DAK-Gesundheit intends to conclude discount contracts for medicines with as many interested pharmaceutical companies as possible until new medicine discount contracts come into force. A discount contract under the licensing model for the aforementioned active substance comes into force for the first time on 01.06.2026 and ends on 31.05.2028 (plus extension option 1x12 months). It ends automatically with the entry into force of the exclusive contract, regardless.
