Subject of the Contract 1. The subject of the contract are successive deliveries of medical supplies. 2. The subject of the contract has been divided into 18 tasks. 3. A detailed description of the subject of the contract is contained in Annex No. 4 to the SWZ. 4. All proprietary names of products and materials as well as standards and certificates referred to in the specification serve to determine the desired standard of execution and properties as well as technical requirements set for the subject of the contract. The Contracting Authority allows the use of equivalent solutions in this case. 5. If the Contracting Authority in the description of the subject of the contract indicates any trademarks, patents or origin, sources or a specific process that characterizes the products or services provided by a specific Contractor, equivalent solutions described may be offered, provided that they maintain the same minimum technical, quality and functional parameters, etc. 6. In the event that the description of the subject of the contract contains references to standards, technical assessments, technical specifications and technical reference systems, as mentioned in Article 101(1)(2) and (3) of the Pzp Act, the Contracting Authority allows equivalent solutions described. 7. Common Procurement Vocabulary (CPV): 33.14.11.10- 4 8. Equivalent conditions are specified in Annex No. 9 to the SWZ. Foreign Entity 1. If the contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of: 1) information from the National Criminal Register, as referred to in point 10.1/1 of the SWZ (Article 2(1)(1) of the Regulation on Subjective Evidence), - submits information from the appropriate register, such as the commercial register, or, in the absence of such a register, another equivalent document issued by the competent judicial or administrative authority of the country in which the contractor has its registered office or place of residence, within the meaning of point 10.1/1 of the SWZ (Article 2(1)(1) of the Regulation on Subjective Evidence); 2) a certificate, as referred to in point 10.1/3 of the SWZ (Article 2(1)(4) of the Regulation on Subjective Evidence), a certificate or another document confirming that the contractor is not in arrears with the payment of social or health insurance contributions, as referred to in point 10.1/4 of the SWZ (Article 2(1)(5) of the Regulation on Subjective Evidence), or a copy or information from the National Court Register or from the Central Register and Information on Business Activity, as referred to in point 10.1/5 of the SWZ (Article 2(1)(6) of the Regulation on Subjective Evidence) - submits a document or documents issued in the country in which the contractor has its registered office or place of residence, confirming respectively, that: a) has not breached obligations related to the payment of taxes, fees or social or health insurance contributions, b) its liquidation has not been opened, bankruptcy has not been declared, its assets are not managed by a liquidator or a court, it has not entered into an agreement with creditors, its business activity is not suspended or it is not in a similar situation resulting from a similar procedure provided for in the provisions of the place of initiation of that procedure. 2. The document referred to in point 10.2/1/1 of the SWZ should be issued no earlier than 6 months before its submission. Documents referred to in 10.2/1/2 of the SWZ should be issued no earlier than 3 months before their submission. 3. If in the country in which the contractor has its registered office or place of residence or the person to whom the document relates has his place of residence, the documents referred to in point 10.2/1 are not issued, or if these documents do not relate to all the cases referred to in Article 108(1)(1), (2) and (4), Article 109(1)(1), (2)(a) and (b) and (3) of the Act, they are replaced respectively in whole or in part by a document containing a statement of the contractor, indicating the person or persons authorized to represent him, or a statement of the person to whom the document was to relate, made under oath, or, if in the country in which the contractor has its registered office or place of residence or the person to whom the document was to relate has his place of residence, there are no provisions on the statement under oath, made before a judicial or administrative authority, a notary, a professional or economic self-government body, competent in relation to the registered office or place of residence of the contractor or the place of residence of the person to whom the document was to relate. The provision of point 10.2/2 applies. PERIOD OF BINDING OF THE OFFER The contractor will be bound by the submitted offer for a period not longer than 90 days from the expiry of the offer submission deadline, i.e. until 24.11.2026, with the first day of the offer binding period being the day on which the offer submission deadline expires. SUBJECTIVE EVIDENCE 3. In accordance with Article 107(2) of the Pzp Act, the Contracting Authority informs that in the event that the contractor does not submit subjective evidence or the submitted subjective evidence is incomplete, the Contracting Authority will call for their submission or completion within the specified deadline. 4. The provisions of paragraph 3 do not apply if the subjective evidence serves to confirm compliance with the features or criteria specified in the description of the criteria for evaluating offers or, despite the submission of the subjective evidence, the offer is to be rejected or grounds for invalidating the procedure arise. 5. The Contracting Authority may request explanations from contractors regarding the content of the subjective evidence.
