Poland – Laboratory reagents – Dostawy odczynników do oznaczania parametrów krytycznych oraz materiałów eksploatacyjnych do analizatorów ABL 90 Flex, będących w posiadaniu Zamawiającego na okres 24 miesięcy - sprawa nr Z/102/PN/26

1. The subject of the contract is the successive delivery of reagents for marking critical parameters and operational materials for ABL 90 Flex analyzers, owned by the Purchaser, for a period of 24 months (hereinafter referred to as the goods), in the type and quantities specified in the price form constituting Annex 2 to the SWZ and in accordance with the planned provisions of the contract constituting Annex 4 to this SWZ. 2. In the event of no demand for the assortment covered by the subject of the contract, the Purchaser reserves the right not to order part of the assortment specified in Annex 1 to the contract, with the reservation of clause 3. The Contractor shall not be entitled to any claims for damages or claims based on any other legal basis, to which the Contractor agrees. 3. The Purchaser guarantees that the minimum value of orders awarded to the Contractor throughout the period of validity of the contract will be 70% of the maximum value of the Contractor's remuneration, as specified in the price form constituting Annex 1 to the contract. 4. The Purchaser informs that in the subject proceedings conducted in the open procedure, it envisages the possibility of applying the procedure referred to in Article 139(1) of the p.z.p. act. When applying the said procedure, the Purchaser will first carry out an examination and evaluation of the tenders, and then carry out a subjective qualification of the Contractor, whose tender was highest rated in terms of the absence of grounds for exclusion and the fulfillment of the conditions for participation in the proceedings.
