The subject of the contract is the sale and delivery of factory-new, unused equipment/assortment/devices along with software as part of the modernization of the Main Server Room of the University of Rzeszów. The subject of the contract has not been divided into parts. The contracting authority does not allow partial offers to be submitted. Reasons for not dividing the contract into parts. The subject of the contract constitutes a functional whole, dividing the contract into parts would have resulted in excessive technical difficulties as well as excessive costs of contract execution, moreover, the lack of division is justified by organisational reasons, any division of the contract could seriously threaten the proper execution of the contract, and the need to coordinate the actions of different contractors implementing individual parts of the contract could threaten the proper and timely execution of the contract. Furthermore, the failure to divide into parts does not violate competition by limiting the possibility of applying for it. 2. A detailed description and the manner of contract execution is contained in the Subject of the Contract (SOC), which is Annex No. 3 to the SWZ. 3. Contractors who meet the conditions regarding: 1) the ability to engage in economic activity: The contracting authority does not set a condition in this regard. 2) the entitlement to conduct a specified economic or professional activity, if this results from separate provisions: The contracting authority does not set a condition in this regard. 3) the economic or financial situation: The contracting authority does not set a condition in this regard. 4) technical or professional capacity: The contracting authority sets a condition in the scope of possessing technical or professional capacity. The contractor will meet the condition if they demonstrate that within the last 3 (three) years before the deadline for submitting offers, or if the period of conducting business is shorter – in this period, they have properly completed at least one single delivery, which included the delivery of servers, storage arrays and network switches for one entity for a total amount of at least 1,100,000.00 PLN gross or properly completed at least three separate deliveries, including one delivery that included the delivery of servers for a total amount of at least 500,000.00 PLN gross, the second delivery that included the delivery of storage arrays for a total amount of at least 300,000.00 PLN gross and the third delivery that included the delivery of network switches for a total amount of at least 300,000.00 PLN gross. The contractor will attach evidence that the deliveries were completed properly. The contracting authority will assess the fulfillment of these conditions based on the submitted documents, evidence and declarations using the 0-1 method: meets/does not meet. Values given in foreign currencies, in documents submitted by contractors to meet the conditions of participation in the framework of this procedure, the contracting authority will convert at the average NBP exchange rate on the date of publication of the contract notice in the BZP. 4. The contracting authority envisages the application of the so-called reverse procedure, as referred to in Article 139(1) of the PZP Act. 5. In accordance with Article 257 of the p.z.p., the contracting authority envisages the possibility of invalidating the substantive procedure if the public funds that the contracting authority intended to allocate for the financing of the whole or part of the contract have not been granted to it. 6. The contracting authority does not require the submission of a bid bond. 7. The contracting authority does not require the provision of a guarantee of proper contract performance. 8.
