Poland – Ambulances – Dostawa dwóch ambulansów drogowych typu C z napędem 4x4
Description
The subject of the order is the delivery of 2 brand-new road ambulances of type "C" with 4x4 drive for the Cieszyn Emergency Medical Service. The ambulances must meet the requirements of the current standard PN EN 1789 or an equivalent standard for type C ambulances. The buyer requires the delivery of brand-new, unused vehicles from the year of manufacture 2026. Detailed requirements regarding the subject of the order, technical description and parameters are included in Annex No. 2 to the SWZ - Parameter Requirements Form. The buyer does not allow the submission of partial offers. The buyer has waived the division of the order into parts, as the subject of the order includes the delivery of two brand-new medical ambulances, constituting a comprehensive product, consisting of a base vehicle, a medical superstructure and complete medical equipment, meeting the requirements of applicable legal regulations and standards for road ambulances. The subject of the order is a single, functionally and organizationally coherent task, co-financed from the funds of the Civil Protection and Civil Defense Program for the years 2025–2026 (Area II). According to the grant agreement, the task includes the purchase of ambulances with 4x4 drive along with equipment (electric stretcher, cardiological chair with electric drive, respirator, infusion pump, electric suction device, defibrillator). Assigning the implementation of the entire order to one contractor will ensure the maintenance of uniform standards of execution and equipment of the vehicles, facilitate their operation, exploitation and servicing, and also ensure the coherence of warranty conditions and the contractor's responsibility for the implementation of the entire order. Dividing the order into parts, particularly by separately awarding a contract for each ambulance, could lead to the delivery of vehicles and equipment differing in the applied technical solutions or standard of execution, and also necessitate the use of different rules for operation, servicing and realization of warranty rights. The implementation of the order by one contractor also ensures unambiguous responsibility for the proper and timely execution of the entire subject of the order and limits the organizational risk associated with coordinating supplies made by several contractors. The non-division of the order into parts does not result from the intention to limit competition, but from the character and functional coherence of the subject of the order, the need to ensure a uniform standard of ambulances and their equipment, and the need to ensure efficient and comprehensive implementation of the task. The lack of division of the order into parts does not therefore lead to a limitation of fair competition or violate the principle of proportionality. There are many contractors on the market, including small and medium-sized enterprises, with the potential to comprehensively implement the subject of the order, so the decision not to divide the order into parts does not limit the possibility of applying for the award of the order. The buyer does not allow the submission of variant offers. The buyer does not introduce a reservation indicating the obligation of personal execution by the Contractor of key parts of the order. The contractor may entrust the execution of part of the order to a subcontractor. The buyer does not provide for the obligation of the Contractor to conduct a local inspection or for the Contractor to verify the documents necessary for the implementation of the order. The buyer did not conduct preliminary market consultations before initiating the procedure. The buyer is not liable for damages caused by the contractor during the execution of the subject of the order. The buyer does not provide for settlement between the buyer and the contractor in foreign currencies. The buyer does not provide for the reimbursement of participation costs. The buyer does not require the obligation of personal execution by the Contractor of key tasks in accordance with art. 60 and art. 121 of the Pzp Act. The buyer does not provide for the award of orders, as referred to in art. 214 para. 1 point 7 and 8 of the Pzp Act. The subject purchase is financed from funds under the Civil Protection and Civil Defense Program for the years 2025–2026 (Area II) from the State Budget and the Budget of the Silesian Voivodeship. The buyer may invalidate the order procedure if the public funds that the buyer intended to allocate for financing have not been granted to them (in accordance with art. 257 of the Pzp Act). All requirements specified in the SWZ documents constitute minimum requirements, the fulfillment of which is obligatory. Failure to meet the above minimum requirements will result in the rejection of the offer as non-compliant with the order conditions on the basis of art. 226 para. 1 point 5 of the Pzp Act. The buyer requires that the offered service, including all ICT products (information and communication technologies), ICT services and ICT processes used to implement the order, both as main elements and as components, environment elements, service deliveries or accompanying solutions, does not include: - ICT products, ICT services or ICT processes indicated in the recommendation, referred to in art. 33 para. 4 of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the basic interest of state security; - an ICT product, the type of which has been determined in a decision on recognizing the supplier as a high-risk supplier, referred to in art. 67b para. 15 of the Act of 5 July 2018 on the national cybersecurity system, or ICT services or ICT processes specified in that decision. Failure to meet the above requirement results in the rejection of the offer on the basis of art. 226 para. 1 point 17 or point 19 of the Pzp Act.
