Poland – Safety training services – Przygotowanie i przeprowadzenie szkoleń dla zarządców dróg z zakresu organizacji ruchu na drogach samorządowych na terenie 16 województw.

The subject of the contract is the preparation and conduct of training for road managers in the field of traffic organization on municipal roads in the territory of 16 voivodeships. The description of the subject of the contract is contained in Annex No. 1 to the SWZ. Due to the limited number of characters in the form for submitting notices electronically, further information regarding the procedure is contained below (numbering transferred from the SWZ): 5.1.4 The obligation of the entity providing resources to make the necessary resources available to it for the implementation of the given contract or another substantive evidential means confirming that the Contractor, in implementing the contract, will have the necessary resources of these entities, in the situation where the Contractor relies on the capacities or situation of the entities providing resources. 5.1.5 The obligation of the entity providing resources, referred to in point 5.1.4, confirms that the relationship linking the Contractor with the entity/ies providing resources guarantees real access to these resources and specifies in particular: - the scope of resources available to the Contractor of the entity providing resources; - the manner and period of making the resources available to the Contractor and their use by him of the resources of the entity providing these resources when executing the contract; - whether and to what extent the entity providing resources, on the capacities of which the Contractor relies in relation to the conditions of participation in the procedure concerning education, professional qualifications or experience, will implement the contract/its part, to which the indicated capacities relate. NOTICE - The Contractor is obliged to fulfill the information obligation provided for in Article 13 or Article 14 of the GDPR with regard to natural persons, from whom personal data were obtained directly or indirectly (in the case of using Subcontractors/Third Parties/Contractors entering into a consortium) in order to apply for the award of the contract in this procedure. 5.1.6 A declaration from which it will result which parts of the contract will be executed by individual Contractors, in the case of Contractors jointly applying for the award of the contract and in relation to the conditions indicated in point 4.1.5 - prepared according to the template constituting Annex No. 5 to the SWZ (if applicable). 5.1.7 A list of persons sent by the Contractor to implement the public contract, in particular those responsible for providing services along with information on professional qualifications, authorizations, experience and education necessary to implement the public contract, as well as the activities performed by them and information on the basis of possession of these persons. The list should be prepared according to the template constituting Annex No. 7 to the SWZ. NOTICE: The submission of lists, referred to in points 5.1.7 and 7.11 lit. e), results from Article 126(2) of the Act. The lists are necessary to ensure the proper course of the procedure, due to the application by the Contracting Authority, as a criterion for evaluating offers, the experience of persons who will be directed to implement the contract, meeting the condition of participation in the procedure, the verification of which requires the evaluation of both documents. 5.5 A Contractor entered in the official register of approved contractors or a contractor certified by certifying entities meeting the requirements of European certification standards, instead of substantive evidential means, referred to in points 5.2.1.-5.2.3, may submit a certificate of entry in the official register issued by the competent authority or a certificate issued by the competent certifying entity of the country in which the Contractor has its registered office or place of residence, indicating the substantive evidential means constituting the basis for entry or obtaining certification, unless the Contracting Authority has justified grounds to question the information resulting from the certificate or certificate. 5.6 The Contractor is not obliged to submit substantive evidential means, referred to in Chapter 5 of the SWZ, if the Contracting Authority can obtain them using free and publicly available databases, in particular public registers within the meaning of the Act of 17 February 2005 on the informatization of the activities of entities performing public tasks, hereinafter referred to as the "Act on Informatization", provided that the Contractor has indicated in the JEDZ data enabling access to these means. The Contractor is not obliged to submit substantive evidential means which the Contracting Authority possesses, if the Contractor indicates these means and confirms their correctness and up-to-dateness. 5.7 Substantive evidential means as well as documents or declarations drawn up in a foreign language must be submitted together with translations into Polish. If the substantive evidential means, documents or declarations, referred to in Chapter 5 of the SWZ, are drawn up in a foreign language, the Contractor is obliged to present their translation into Polish. 7.11 The offer must include: a) FO prepared and issued according to the template constituting Annex No. 6 to the SWZ, in which, inter alia, the price should be indicated; b) power of attorney or another document confirming the authorization to represent the Contractor – if applicable; c) declarations and documents, referred to in point 5.1 with the reservation that documents, referred to in points 5.1.4 and 5.1.6 – if applicable; d) justification for the reservation of information contained in the offer as a business secret – if applicable; e) list "Experience of persons directed to implement the contract", containing information allowing for an assessment in accordance with the offer evaluation criterion specified in point 12.3. The list should be prepared according to the template constituting Annex No. 8 to the SWZ. f) document subject to evaluation in accordance with the criteria indicated in point 12.4 SWZ, i.e. "Preliminary concept of conducting a two-day training", incl.: a) Complexity and coherence of the concept; b) Diversity of activating and workshop methods; g) in the case of submitting objections in a form other than monetary, the original of the objection document (guarantee or surety). 16.1 The projected provisions of the agreement constitute Annex No. 2 to the SWZ.
