This is a negotiated procedure with a participation competition pursuant to Section 11(1) Sentence 1 Alternative 2 VSVgV. The subject of the contract to be awarded is the procurement for the delivery and installation of software as an overall system a) for the analysis, IT-supported comparison and research of bulk data in a stock of several partly federated source databases and data imported on an ad hoc basis, particularly from the backups of digital evidence by the police SH, b) for the technical integration of existing data sources in a central data integration platform (data integration component). The licensing requirement initially comprises 30 simultaneous users; the license quantity required for this must be procured. There should optionally be the possibility to expand the number to up to 75 simultaneous users. This option must be included in the offer, but the actual use is optional. The contracting authority provides for a tiering of the further optionally purchasable licenses. The additional licenses are offered in tiers: Option 1 enables the procurement of 20 further licenses (a total of 50 users), Option 2 enables a further 25 licenses each, so that a maximum number of 75 users can be achieved. The license term is three years from the award. The contracting authority has the right to extend the term up to three times by twelve months each. Licenses acquired under Options 1 and 2 have a term of three years from their provision, which can also be extended three times by twelve months each, but the licenses procured by exercising the option expire at the latest simultaneously with the term of the initially procured licenses. The contracting authority uses an EVB-IT transfer contract Type B, an EVB-IT maintenance contract and an EVB-IT service contract as the basis for the contractual agreement. These will be made available together with the further documents in the tendering phase. The procurement essentially comprises the following services: The leasing of an overall system consisting of • an analysis software for the comprehensive analysis, IT-supported comparison and research of bulk data in the stock of several partly federated source databases and data imported on an ad hoc basis, particularly from the backups of digital evidence by the police SH and • a central data integration platform (data integration component) for the integration of the existing data sources, which can be installed in the data centre of Dataport - on premise. This includes a production, development and test system, which is to be integrated into the existing IT infrastructure of the police SH. Regarding the delimitation of data integration from IT-supported comparison and automated data analysis, reference is made to the attached document "Definition of Terms Analysis and Data Integration". Further details can be found in the document "Part A - General Part Participation Competition". The procedure concerns a classified matter contract pursuant to Section 104(3) No. 2 GWB or Art. 2 lit. b and d Directive 2009/81/EC and is carried out in accordance with the VSVgV. Only economic operators established in an EU Member State or Iceland or Norway ("eligible participants") are entitled to participate (by application and tenders) according to the decision of the contracting authority. Bidders and tenderers may not provide subcontractors in their application and tenders who are established in a state other than those mentioned in the previous sentence ("third country"). This also applies to the otherwise reference to the capacities of such companies. For determining the place of establishment, the definition of origin in Article 3(1) of Regulation (EU) 2022/1031 applies accordingly, for economic operators as groups Article 3(2) of the aforementioned regulation.
