The subject of the contract is the purchase and delivery of medicinal products – medicines, contrast agents and pharmaceutical raw materials for the needs of the Katowice Oncology Centre in the forms, doses and estimated quantities, the list of which, divided into Packages from 1 to 423, constitutes Annex No. 2 to the SWZ – Price Offer. The subject of the contract is a medicinal product – with an international name in the form and dose specified by the Buyer. 2. Designation of the subject of the contract in the Common Procurement Vocabulary: 33600000-6 pharmaceutical products, 3. Requirements: 1) The quantities of the medicinal product ordered may be reduced during the validity of the contract depending on the current needs of the Buyer related to the health services provided and will result from current orders without the possibility of claims by the Contractor due to the reduction in the quantity of the purchased medicine. However, in the case of medicines dedicated to specific patients, the Buyer reserves the right not to provide the given medicine. 2) The quantity of the ordered goods will not be less than 50% of the value of the Contract. 3) The medicinal product must be delivered in accordance with the applicable regulations in this respect. 4) The Buyer understands the purchase and delivery of medicinal products as deliveries to the Hospital Pharmacy carried out continuously upon request of the Buyer within the terms specified by him, i.e.: a) urgent – within a maximum of 24 hours b) planned – within 48 hours from the date of the order placed by the Buyer by electronic mail. If the delivery falls on a non-working day or outside the working hours of the Hospital Pharmacy, the delivery will take place on the first working day after the specified date. 5) The Contractor must guarantee the possibility of placing orders sent electronically from Monday to Friday between 8.00 – 16.00. 6) The Contractor, when submitting an offer, simultaneously submits a declaration of having the delivery secured for the entire period of the contract execution. 7) In the event of non-fulfilment of the order within the time specified in the contract, the Buyer will make an emergency purchase of the medicinal product, and the Contractor agrees to cover the difference arisen between the emergency purchase price and the one resulting from the contract. 8) The Buyer requires that the medicines, which are the subject of this procedure, are medicines on the list – register of reimbursed medicines (in the scope of medicines to which this applies) and enable the Buyer to report to the NFZ therapies with their use (utilisation), understood as the payment by the Payer-NFZ of the costs of treatment. 4. Information regarding the equivalent: 1) In Annex No. 2 to the SWZ – Price Offer, in the column “Dose, form, size of the package of the equivalent offered by the Contractor” it is allowed to include in the offer a preparation equivalent with the indication of the dose, form and appropriate size of the package. 2) The Buyer allows an equivalent medicinal product on the condition that the costs of treatment can be refunded by the National Health Fund. 3) The packaging of the equivalent preparation may not deviate from the permissible size of the package of the given position specified in Annex No. 2 to the SWZ – Price Offer. 4) An equivalent that contains a different dose and form than that mentioned in Annex No. 2 to the SWZ – Price Offer will not be taken into account. 5) In the case of offering an equivalent medicinal product, in Annex No. 2 to the SWZ – Price Offer, in the columns entitled:  “Net unit price”  “Net value”  “Gross value” the values relating to the offered equivalent medicinal product should be indicated. 5. The Buyer allows the submission of partial offers, i.e. for individual complete Packages. In the event that the Contractor submits the most advantageous offers for more than one of the Packages, one contract will be concluded, in which each Package will be an independent element to which all its provisions will apply, including the possibility of its termination. 6. The Buyer allows the submission of equivalent offers, on the terms specified in this SWZ. 7. The Buyer does not allow the submission of variant offers. Right of option. a. The quantities given in Annex No. 2 to the SWZ – Price Offer serve only for the purpose of comparing offers. The final value of the subject of the contract will be determined on the basis of the actual quantity of the order, resulting from the actual demand of the Buyer, multiplied by the unit price. b. The Buyer allows the possibility of transferring unused financial resources between the individual Packages covered by the contract. c. In the event that the Contractor implements more than one Package - the Buyer, within the exercised right of option, reserves the right to increase the quantities of individual positions, which are the subject of the contract for the order, provided that the unit prices from the offer are maintained and the maximum value of the Contract is not exceeded.
