The gematik intends to conclude a framework agreement for the hiring out of workers with all companies that meet the defined participation requirements and join the contract system. This framework agreement applies to the conclusion and execution of hiring out of workers contracts between the user and the hirer in one or more of the following service categories (job families). The selection of the service categories to be covered by this contract is made by the hirer. The service categories are as follows: • […] Development • […] Architecture • […] Coordination/Management • […] (Business) Administration • […] Communication & Marketing • […] Service Management • […] Infrastructure • […] Data (Analytics) The services of the hirer are to be provided in accordance with the framework agreement, the respective individual call-off and the individual hiring out of workers contract to be concluded on the basis of the framework agreement, the description of services (Annex 2) which is a contractual component, the supplementary annexes and applicable documents as well as the applicable legal provisions. The present open-house model does not constitute, in the opinion of the contracting authority, the award of a public contract within the meaning of Directive 2014/24/EU or of national public procurement law, since no selection decision is made between the companies eligible to join. Interested companies can join the contract system throughout the entire term, without any form of tender evaluation taking place. The qualitative requirements for the services as well as the remuneration are determined and published in advance. Contract contents, conditions and access procedures are not negotiable. The present publication does not constitute the award of a public contract within the meaning of Directive 2014/24/EU of the European Parliament and of the Council or of public procurement law. To ensure the greatest possible degree of transparency for the intended contract awards, the publication is made in the Supplement to the Official Journal of the European Union. In the absence of a corresponding publication form, the contract notice is used. The resulting terminological specifications, such as the procedure designation, the above-mentioned time limits for the procedure and a technically prescribed reference to suitability and award criteria, are solely due to the use of this notice form and the publication platform. No further significance, in particular no submission to public procurement regulations, is associated with this, unless required by law.
