A detailed description of the subject of the contract is provided in Annex 2 to the SWZ / Annex 1 to the contract - assortment-price form/option, on the basis of the template contract constituting Annex 4 to the SWZ. The Contractor undertakes, within the subject of the contract (among others), to: 1) Supply, install, and commission the equipment at their own cost and effort 2) Provide the Purchaser with detailed instructions for use and maintenance of the equipment in Polish, warranty cards, 3) Train the Purchaser's staff in the use and operation at the Purchaser's premises, in the number indicated by the Purchaser after agreeing with the Purchaser on the date, before signing the final acceptance protocol 4) Perform during the warranty period: warranty service and periodic inspections (in accordance with the manufacturer's guidelines in this regard), without charging separate fees for this 5) Other requirements described in detail in the annexes to the SWZ. The Purchaser allows the submission of equivalent offers The Contractor, who refers to equivalent solutions, is obliged to demonstrate that the solution offered by him meets the requirements specified by the Purchaser. In such a case, the Contractor attaches to the offer a list of equivalent solutions. a) The Purchaser reserves the right that wherever in the documentation, constituting a description of the subject of the contract, trademarks, patents or origin, sources or detailed processes have been indicated, which characterize the products or services supplied by a specific contractor - the Purchaser allows methods, materials, devices, systems, technologies, etc. equivalent to those presented in the description of the subject of the contract. Therefore, it is allowed to propose in the offer all equivalent market counterparts with properties not worse than those indicated by the Purchaser. The parameters of the indicated standard determine the minimum technical, operational, user, quality and functional conditions that the subject of the contract must meet. The indicated trademarks, patents, brands or names of the manufacturer or source or special processes indicating the origin only indicate the class of the product, methods, materials, devices, systems, technologies, etc. b) In the offer, methods, materials, devices, systems, technologies, etc. of other brands and manufacturers can be accepted, but with technical, quality and user properties and functional properties corresponding to the methods, materials, devices, systems, technologies, etc. described in the SWZ. c) The Purchaser, by describing the subject of the contract by referring to standards, European technical assessments, approvals, technical specifications and technical reference systems, allows the use of solutions equivalent to those described, and in such a reference, the words "or equivalent" are added. d) In the event that in the documentation constituting the description of the subject of the contract is described using specific standards, European technical assessments, approvals or technical specifications and technical reference systems and by indicating trademarks or origin, the Purchaser informs that this entry is only exemplary and constitutes an indication for the Contractor of what features the materials used to implement the subject of the contract should have. The Purchaser allows the implementation of the contract through the use of equivalent solutions. The Purchaser, by providing the names of proprietary products, determines the minimum technical parameters, user and quality features (including: dimensions, composition, material used, color, shade, purpose of the devices, aesthetics, etc.) to which equivalent materials should correspond, in order to meet the requirements set. e) Whenever equivalent solutions have been allowed in the description of the subject of the contract, this means: a technically similar solution and not worse in terms of the functional parameters described by the Purchaser. f) The Contractor submitting an equivalent offer is obliged to prove the equivalence of the offered products. The Purchaser does not divide the contract into parts and therefore does not allow the submission of partial offers. Offers not containing the full scope of the subject of the contract will be rejected. Reasons for not dividing the contract into parts: Dividing the subject of the contract into parts would threaten excessive technical difficulties and would require the need to coordinate the actions of different Contractors implementing individual parts of the service at the same time, which would result in a significant increase in supervision and coordination costs. The works related to the implementation of the works are closely related to each other and it is indicated that they should be carried out by one Contractor. Any division of the task would be detrimental to the Purchaser, as it would cause excessive technical difficulties, and above all excessive costs of contract execution - this refers to the situation in which the services covered by the subject of the contract would be carried out by several Contractors on the basis of separate contracts. At the same time, the lack of division of the contract into parts does not limit competition and ensures equal access for entities from the sector of small and medium-sized enterprises. It is envisaged to invalidate the procedure for awarding the contract, in the event of not granting funds, which the Purchaser intended to allocate for the financing of the whole or part of the contract.
