Poland – Sauces – DOSTAWA NAPOJÓW BEZALKOHOLOWYCH, SOSÓW, ZUP, PRZYPRAW, KAWY I HERBATY, MIODU

The subject of the order is the delivery of non-alcoholic beverages, sauces, soups, processed spices, coffee and tea, honey, for the 31st Tactical Air Base. The detailed description of the subject of the order, the applicable documents and the quality requirements referred to in Article 246(2) of the Pzp Act on the subject of the order are contained in Annex No. 7 – "Description of the subject of the order" and Annex No. 4 to the SWZ – "Draft contract" to the SWZ. The scope of the order is contained in Annex No. 1A to the SWZ - price list. The ordering party allows the submission of partial offers, the order consists of 4 tasks: Task 1 - non-alcoholic beverages, Task 2 - sauces, soups, processed spices, Task 3 - coffee, tea Task 4 - honey. Before signing the contract, the contractor shall submit to the ordering party: Current document confirming the application of the implemented HACCP system: a) HACCP system certificate implemented by companies holding accreditation and authorisation from the Polish Centre for Accreditation based in Warsaw, or b) Statement from the competent authority of the State Sanitary Inspection or the competent authority of the Veterinary Inspection confirming supervision over the application of the principles of the implemented HACCP system. The submitted statement must confirm that the contractor has implemented and applies the principles of the HACCP system – Legal basis: Article 59 and 73 of the Act of 25 August 2006 on food and feed safety. The ordering party will invalidate the procedure for awarding the order if the funds from the budget, which the ordering party intended to allocate to finance all or part of the order, have not been granted to it. The ordering party informs that the entry of foreigners to military complexes requires prior written permission issued in accordance with Decision No. 107/MON of the Minister of National Defence of 18 August 2021. Order execution deadline: 31.12.2028. Predicted start date for delivery implementation: 01.01.2027. After evaluating the offers, the ordering party will call the contractor, whose offer was the highest rated, to submit the following personal evidentiary means, 2.1. To confirm the absence of grounds for exclusion: 2.1.1INFORMATION FROM THE NATIONAL CRIMINAL REGISTER in the scope of: - Article 108(1)(1) and (2) of the Pzp, - Article 108(1)(4) of the Pzp, regarding the final judgment of the prohibition to apply for a public contract by means of a criminal penalty, drawn up no earlier than 6 months before its submission. 2.1.2CONTRACTOR'S DECLARATIONS, in the scope of Article 108(1)(5) of the Pzp, ON THE LACK OF BELONGING TO THE SAME CAPITAL GROUP in the sense of the Act of 16 February 2007 on the protection of competition and consumers (Journal of Laws of 2025, item 1714), with another contractor who submitted a separate offer, partial offer or application for admission to the proceedings, or a declaration of belonging to the same capital group together with documents or information confirming the preparation of the offer, partial offer or application for admission to the proceedings independently of another contractor belonging to the same capital group – prepared in accordance with the template constituting Annex No. 3 to the SWZ. 2.1.3CONTRACTOR'S DECLARATIONS on the currency of the information contained in the declaration, referred to in Article 125(1) of the Pzp (JEDZ), in the scope of the grounds for exclusion from the proceedings indicated by the ordering party, referred to in: 1)Article 108(1)(3) of the Pzp, 2)Article 108(1)(4) of the Pzp, regarding the final judgment of the prohibition to apply for a public contract by means of a preventive measure, 3)Article 108(1)(5) of the Pzp, regarding the conclusion with other contractors of an agreement aimed at disrupting competition, 4)Article 108(1)(6) of the Pzp, in accordance with the template constituting Annex No. 5 to the SWZ. 2.1.4. CONTRACTOR'S DECLARATION regarding the EXCLUSION PREMISES FROM ART. 5K OF REGULATION 833/2014 AND ART. 7(1) OF THE ACT on special solutions in the field of counteracting the support of aggression on Ukraine and serving to protect national security, submitted on the basis of Article 125(1) of the Pzp, which the ordering party provided for in Section VII(5) of the SWZ, in accordance with the template constituting Annex No. 6 to the SWZ. 3. The personal evidentiary means indicated in point 2.1 may be replaced by a valid certificate of the contractor of public contracts, referred to in Article 124(2) of the Pzp, exclusively in the scope in which the certificate confirms the absence of grounds for exclusion or the fulfilment of the conditions for participation in the proceedings in the scope corresponding to the requirements specified in the SWZ. The certificate does not replace the personal evidentiary means concerning the grounds for exclusion not covered by the certification, in particular Article 7(1) of the Act of 13 April 2022 on special solutions in the field of counteracting the support of aggression on Ukraine and serving to protect national security, as well as the circumstances that arose in the course of the current proceedings and Article 5k of Council Regulation (EU) No. 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU No L 229 of 31 July 2014). 4. The certificate replaces the personal evidentiary means exclusively in the scope covered by the valid certification and indicated by the contractor in the JEDZ declaration. If the certificate covers only part of the grounds for exclusion or part of the condition for participation in the proceedings, or confirms the fulfilment of the condition at a lower level than required in the SWZ, the contractor submits personal evidentiary means in the remaining scope. 5. In the scope resulting from the valid certificate, the ordering party does not require other personal evidentiary means from the contractor, with the reservation of Article 124(4) of the Pzp and Article 31(6) of the Act on the certification of contractors of public contracts.
