Description
The concession concerns the conclusion with the City of Brussels of a concession agreement for the operation of a Class I gambling establishment (casino), as defined in Article 29, paragraph 3, of the Law of 7 May 1999. The concessionaire will be responsible for operating the casino. To this end, it must obtain a Class A licence issued by the Belgian Gaming Commission. The tenderer must therefore also meet the conditions required to obtain such a licence. The agreement is concluded subject to the suspensive condition of the concessionaire obtaining the Class A licence from the Gaming Commission (Article 18 of the Royal Decree of 26 June 2002). The concession is operated at the following location: In the multifunctional complex, formerly known as "GALERIES ANSPACH", located at Boulevard Anspach 30 to 36 and formed by the streets Grétry, des Fripiers and the rue de l’Evêque, previously cadastral section B, number 1472/G (48a 67ca), number 1600/P (3a 45 ca) and number 1600/S (115.75 m²), and according to a recent cadastral extract section B number 1472KP0000 for a total cadastral area of 52 ares 54 centiares: The entity named "Casino", cadastral section B, number 1472KP0122, consisting of the following areas: • An area of 11,530 m² for the casino activity; • An area of 950 m² currently used for the restaurant on the seventh floor; • An area of 1,885 m² in the basement for parking and storage. A total area of 14,365 m². The multifunctional complex, formerly known as "GALERIES ANSPACH", is the property of the City of Brussels. However, the City of Brussels has granted a right of emphyteusis over this complex to the SA NOUVELLES GALERIES DU BOULEVARD ANSPACH (hereinafter "NGBA"), which is the emphyteute. In order to operate the premises, the concessionaire will be granted a right of superficiary by the emphyteute. The terms and conditions related to this right of superficiary are set out in the draft deed of superficiary in Annex 4 of this tender dossier, which the concessionaire will be required to sign. In addition to operating the casino, the concessionaire will be responsible for operating the various HoReCa services located in the premises subject to this concession and for organising events on the site.
