Description
The subject of the contract is the delivery of server and network equipment along with implementation. The detailed description of the subject of the contract (hereinafter: "OPZ") along with the draft terms of the contract constitute Annex 1 and 2 to the SWZ. 2. The Contracting Authority requires the submission of the following subject-specific evidence: 1) feature and functionality form (Annex 4 to the SWZ); 2) CE declaration of conformity (or equivalent) for the offered Devices; 3) Contractor's statement regarding the execution of the contract (Annex 12 to the SWZ); 4) a document confirming the country of origin, not being a self-declaration of the contractor (e.g. a quality certificate, CE declaration of conformity, catalogue card). 3. The Contracting Authority accepts equivalent subject-specific evidence if it confirms that the offered supplies meet the requirements, characteristics or criteria specified by the Contracting Authority. With regard to certificates issued by a specified conformity assessment body, the Contracting Authority also accepts certificates issued by other equivalent conformity assessment bodies. 4. If the Contractor does not submit the subject-specific evidence or the submitted subject-specific evidence is incomplete, the Contracting Authority will request their submission or completion, within the time limit set by the Contracting Authority, with the reservation of art. 107 (3) of the Pzp Act. The Contracting Authority may request explanations regarding the subject-specific evidence. 5. In matters not regulated in the SWZ, the provisions of the Ordinance of the Minister of Development, Labour and Technology of 30 December 2020 on the subject-specific evidence and other documents or declarations which the Contracting Authority may require from the Contractor (Journal of Laws of 2020, item 2415) shall apply. 6. The Contracting Authority does not require the submission of objections. 7.1. Contractors who meet the participation conditions may apply for the contract, concerning: 1) the ability to operate in the economic turnover (no requirements); 2) authorisation to carry out a specific economic or professional activity, if this results from separate provisions (no requirements); 3) economic and financial situation (no requirements); 4) technical or professional capability: The Contractor shall demonstrate that, in the last 3 years before the deadline for submitting offers, or if the period of operation is shorter, in that period, it has properly completed at least 3 contracts (each under a separate agreement) with a value of not less than 700,000.00 PLN net each, the subject of which was the delivery of server, network infrastructure, SAN arrays along with installation, configuration, commissioning and migration of the existing client environment to the latest supplied versions within one service. 7.2. In the case of Contractors jointly applying for the contract, the conditions specified in paragraph 1 must be met by at least one Contractor or all Contractors together, in accordance with the law. Contractors jointly applying for the contract shall submit, in accordance with the law, a declaration, as referred to in art. 117 (4) of the Act. The template for the declaration is Annex 8 to the SWZ. 7.3. In the case where a Contractor relies on experience gained in a contract carried out by contractors jointly applying for the contract (consortium), the Contracting Authority does not allow the Contractor to demonstrate the experience of a group of contractors, of which it was a member, if it did not actually and specifically perform the given scope of activities. The Contracting Authority reserves the right to ask the Contractor for explanations regarding the actual and specific scope of activities performed and to present appropriate evidence, e.g. a consortium agreement, from which the scope of obligations results, or invoices issued by the contractor. 7.4. The Contractor may, in order to confirm compliance with the conditions for participation in the procedure, rely on the technical or professional capabilities or financial or economic situation of entities providing resources, regardless of the legal nature of the legal relations linking them. Contractors relying on the capabilities of an entity providing resources shall submit, together with the offer, in accordance with the law, a commitment or other subject-specific evidence, as referred to in art. 118 (3) of the Act. The template for the commitment is Annex 7 to the SWZ. 7.5. The Contractor may not, after the deadline for submitting offers, rely on the capabilities or situation of entities providing resources, if at the stage of submitting offers it did not rely on the capabilities or situation of entities providing resources in that scope. 7.6. The Contracting Authority will assess compliance with the conditions for participation in the procedure on the basis of the declarations and documents indicated in Section XV (1) and (5) of the SWZ. The Contracting Authority will sign a contract for the execution of the contract with the selected Contractor, no earlier than after the expiry of the period specified in art. 515 (1) (1) of the Act. 8. If the Contractor whose offer was selected as the most advantageous withdraws from concluding the contract for the public contract, the Contracting Authority may carry out a new examination and evaluation of the offers among the offers of the remaining Contractors in the procedure and select the most advantageous offer or invalidate the procedure. 9. If the offer of Contractors jointly applying for the contract is selected, the Contracting Authority may request, before concluding the contract for the public contract, a copy of the agreement regulating the cooperation of those Contractors. The above agreement should, in particular, specify: the principles of cooperation, the scope of co-participation and the division of obligations of the Contractors in the execution of the subject of the contract. 10. Before signing the contract, the selected Contractor will provide the Contracting Authority with the information necessary for inclusion in the contract, e.g. the names and surnames of the authorised persons who will represent the Contractor at the signing of the contract. 11. The Contracting Authority requires the selected Contractor to conclude a contract for the public contract on the terms specified in the draft terms of the contract, constituting Annex 2 to the SWZ.
