Description

The procurement procedure is conducted in the form of an unrestricted tender, pursuant to Article 132 of the Act of 11 September 2019 on Public Procurement, hereinafter referred to as the “Pzp Act”, the executive acts issued on the basis thereof, and the Civil Code. In matters not regulated by this SWZ, the provisions of the Pzp Act shall apply. 2. The Contracting Authority, in accordance with Article 139 of the Pzp Act, provides for a reversed order of actions, i.e. it may first conduct an examination and evaluation of offers, and then carry out the qualification of the Contractor whose offer has been highest evaluated in terms of the absence of grounds for exclusion. The Contracting Authority shall exclude Contractors who are subject to exclusion on the basis of the reasons set out in Article 108(1) of the Pzp Act and Article 7(1) of the Act of 13 April 2022 on specific solutions to counter the support for aggression against Ukraine and serving to protect national security (Journal of Laws of 2025, item 514) and Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (Official Journal of the EU L 229 of 31.7.2014, p. 1), hereinafter: Regulation 833/2014, as amended by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (Official Journal of the EU L 111 of 8.4.2022 p. 1). 7. In the case of joint submission of offers by Contractors, the Contracting Authority shall examine whether there are grounds for exclusion against each of these Contractors. 8. If the Contractors intend to entrust the execution of part of the contract to a Subcontractor, the Contracting Authority shall examine whether there are grounds for exclusion against that Subcontractor, which have been provided for with respect to the Contractor. Before selecting the most advantageous offer, the Contracting Authority shall invite the Contractor whose offer has been highest evaluated to submit, within a specified time limit, not shorter than 10 days, current, as of the date of submission, personal evidence: 1) lack of grounds for exclusion: a) information from the National Criminal Register in the scope of Article 108(1)(1), (2) and (4) of the Pzp Act, prepared no earlier than 6 months before its submission; b) the Contractor, in the scope of Article 108(1)(5) of the Pzp Act, of not belonging to the same capital group within the meaning of the Act of 16 February 2007 on the protection of competition and consumers, with another Contractor who submitted a separate offer or a declaration of belonging to the same capital group together with documents or information confirming the preparation of the offer independently of another Contractor belonging to the same capital group; the declaration shall be prepared on a form consistent with the content of Annex No 5 to the SWZ; c) declarations regarding the currency of the information contained in the JEDZ form, prepared on a form consistent with the content of Annex No 9 to the SWZ.
