Poland – Non-hazardous refuse and waste treatment and disposal services – „Usługa-wywóz odpadów komunalnych wraz z umożliwieniem ich segregacji, utylizacja oraz wyposażeniem w pojemniki do składowania odpadów oraz odbiór i wywóz nieczystości płynnych ( zamówienie z podziałem na 11 części )”

The subject of the contract is the disposal of municipal waste with the possibility of its segregation, utilisation, and provision of containers for waste storage, as well as the collection and disposal of liquid waste for the years 2027-2028. 2) The present contract has been divided into 11 parts: a) part 1 – “Collection and disposal of municipal waste with the possibility of its segregation, utilisation, and provision of containers for waste storage in the town of Mielec”; b) part 2 – “Collection and disposal of municipal waste with the possibility of its segregation, utilisation, and provision of containers for waste storage in the town of Suków”; c) part 3 – “Collection and disposal of municipal waste with the possibility of its segregation, utilisation, and provision of containers for waste storage in the town of Sandomierz”; d) part 4 – “Collection and disposal of municipal waste with the possibility of its segregation, utilisation, and provision of containers for waste storage in the town of Radoszki”; e) part 5 – “Collection and disposal of municipal waste with the possibility of its segregation, utilisation, and provision of containers for waste storage in the town of Ostrowiec Świętokrzyski, Słoneczne Estate”; f) part 6 – “Collection and disposal of municipal waste with the possibility of its segregation, utilisation, and provision of containers for waste storage in the town of Ostrowiec Świętokrzyski, Hedy Street”; g) part 7 – “Collection and disposal of liquid waste from the town of Nowa Dęba”; h) part 8 – “Collection and disposal of liquid waste from the town of Lipa”; i) part 9 – “Collection and disposal of liquid waste from the town of Suków”; j) part 10 – “Collection and disposal of liquid waste from the town of Kielce, Mielczarskiego Street”; k) part 11 – “Collection and disposal of liquid waste from the town of Radoszki.” The detailed specification of the service constituting the subject of the contract implemented within the framework of the contract are the annexes to this SWZ, i.e. the detailed cost estimate form and the description of the subject of the contract (separately for each part). The Contracting Authority, taking into account the nature of the subject of the contract, does not envisage the inclusion of requirements in the field of accessibility for persons with disabilities in accordance with Article 100(1) of the Act of 11 September 2019 – Public Procurement Law. The projected provisions of the agreement on public procurement, presented in the annex to this SWZ, i.e. the draft agreement (separately for each part), and supplement the description of the subject of the contract in the scope of provisions not regulated by the records. The agreement is in force from the date of its conclusion until 31.12.2028, with the reservation that the commencement of the service will not be earlier than from 1 January 2027. 25. The tender consists of: 1) Tender Form – completed and signed with a qualified electronic signature by persons authorised to represent the Contractor, prepared in accordance with the template constituting the annex to the SWZ, 2) Detailed Cost Estimate Form (according to the part for which the Contractor is applying) – completed and signed with a qualified electronic signature by persons authorised to represent the Contractor, prepared in accordance with the template constituting the annex to the SWZ. The Contracting Authority in this procedure does not require the submission of objections. Each Contractor may submit only one tender (in the scope of a given part). The Contracting Authority envisages the possibility of invalidating the substantive procedure on the basis of Article 257(1) of the Pzp Act, i.e. in the event that the funds which the Contracting Authority intended to allocate for the financing of the whole or part of the contract have not been granted to it. The Contractor will be bound by the tender submitted for a period of 90 days, i.e. until 09.01.2027. The period of binding by the tender begins with the expiry of the tender submission deadline. In the event that the selection of the most advantageous tender does not take place before the expiry of the tender binding period specified in the SWZ, the Contracting Authority, before the expiry of the tender binding period, will contact the Contractors once to express their agreement to extend this period by the period indicated by it, not longer than 60 days. The extension of the tender binding period requires the Contractor to submit a written statement of agreement to extend the tender binding period. In the event that the Contracting Authority requests the submission of objections, the extension of the tender binding period will take place together with the extension of the validity period of the objections or, if this is not possible, with the submission of a new objection for the extended tender binding period. Refusal to agree to extend the tender binding period does not result in the loss of the objection. The Contracting Authority, on the basis of Article 226(1)(12) of the Pzp Act, will reject the tender if the Contractor does not express written agreement to extend the tender binding period. The Contracting Authority may make a selection of the most advantageous tender after the expiry of the tender binding period, if the Contractor, in response to the Contracting Authority's request, expresses written agreement to select his tender after the expiry of the tender binding period. In this procedure for the award of the contract, communication between the Contracting Authority and the Contractors takes place electronically via the Procurement Platform available at: https://platformazakupowa.pl/transakcja/1367895 and the form “Send a message to the Contracting Authority”. The button “Send a message to the Contracting Authority” is used to ask questions about the SWZ, respond to the Contracting Authority's requests or send appeals. The Contractor, by participating in this procedure for the award of a public contract: 1) accepts the terms of use of www.platformazakupowa.pl specified in the Regulations published on the website in the “Regulations” tab and acknowledges them as binding, 2) has familiarised themselves with and will comply with the Instructions available at: https://platformazakupowa.pl/strona/45-instrukcje. The opening of tenders is non-public. In accordance with the Act of 11 September 2019 - Public Procurement Law, the Contracting Authority is not obliged to conduct a tender opening session in a transparent manner with the participation of Contractors or to transmit the tender opening session via electronic tools for online video transmission, but has only such entitlement.
