The subject of the contract is the delivery of various medicines in accordance with 4 packages to the Contracting Authority's premises (Kraków, os. Złotej Jesieni 1), in accordance with the description and requirements set out in Annex 1 to this specification. 2. For cytotoxic drugs/monoclonal antibodies, the Contracting Authority requires the inclusion in the tender of the data required in the SWZ, in particular Annex 1 to the SWZ, relating to the density of solutions or the mass of excipients. 3. The validity period / warranty period of the subject of the contract must not be shorter than 12 months from the date of delivery, and for food products – not shorter than 12 months, but not shorter than 6 months. Deliveries of products with a shorter validity period may be allowed in exceptional situations and each time the Contracting Authority's authorized representative must give consent for them by e-mail confirmation. 4. In drug and chemotherapy programs, only drugs listed on the NFZ reimbursement lists are allowed (the price of the drug must not exceed the funding limit set by the NFZ). 5. By specifying in the Specification, for example, "tabl.", the Contracting Authority means all types of tablets; "kaps." means all types of capsules, etc.; in other cases, the form is specified exactly: for example, "tabl. dojelitowa" means that only a dojelitowa tablet is allowed. 6. By a medicinal product constituting part of the subject of the contract, it is meant medicinal products within the meaning of the Pharmaceutical Law of 6 September 2001 (i.e. Journal of Laws of 2025, item 750, as amended). The offered medicinal product must be authorised for marketing in accordance with the provisions of Article 3 or Article 4(1) and (2) or Article 4a of the Pharmaceutical Law. 7. The offered special-purpose foodstuffs constituting part of the subject of the contract must meet adequate requirements and be authorised for marketing in accordance with the provisions of the Act of 25 August 2006 on Food and Nutrition Safety (i.e. Journal of Laws of 2023, item 1448, as amended) and executive acts, including the Regulation of the Minister of Health of 16 September 2010 on special-purpose foodstuffs (i.e. Journal of Laws of 2015, item 1026). 8. The Contracting Authority, in the implementation of this contract in the part concerning the transport of products to the Contracting Authority's premises, allows the participation of subcontractors holding the relevant authorisations. 9. The remaining conditions of the contract are specified in the draft contract, which is Annex 3 to the Specification. The award of the contract may be sought by Contractors who meet the conditions specified in Article 57 of the Pzp Act and Article 112(2) of the Pzp Act, i.e.: 1) are not excluded 2) meet the participation conditions, concerning: a) the ability to operate in business activity The Contracting Authority does not set a specific participation condition in the Procedure. b) the authorisation to carry out a specified economic or professional activity • the award of the contract may be sought by Contractors who prove that they hold a licence to trade in medicinal products - this applies to packages 1-4; The Contracting Authority will assess the fulfilment of this participation condition in the procedure on the basis of the documents submitted by the Contractor as referred to in Section X.2(1)(g) c) the economic or financial situation The Contracting Authority does not set a specific participation condition in the Procedure. d) technical or professional capacity The Contracting Authority does not set a specific participation condition in the Procedure. Contractors who are not excluded from the procedure on the basis of Article 108 of the Pzp Act and Article 109(1)(1) and (4) of the Pzp Act and who are not excluded from the procedure on the basis of Article 7(1) of the Act of 13 April 2022 on specific solutions to counter the support for aggression against Ukraine and serving to protect national security (Journal of Laws of 2022, item 835), and who are not prohibited from awarding or further executing any public contracts on the basis of Article 5k(1) of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L 229, 31.07.2014, p. 1, as amended).
