Section 130a, paragraph 8, of the German Social Code (SGB V) allows health insurers and pharmaceutical companies to conclude framework discount agreements for medicines to be dispensed at the expense of the statutory health insurers. With regard to the applicable legal provisions for the award of public contracts, the DAK-Gesundheit regularly conducts substance-related, formal tendering procedures in accordance with the regulations of Part 4 of the German Competition Act (GWB). For the medicines to be specified by the bidder in Annex 2 to the contract, namely the proprietary medicinal product OLIMEL (excluding electrolyte-free; 7.6%; KPG) and interchangeable FAM, ATC B05BA10, the DAK-Gesundheit intends to conclude medicine discount agreements with as many interested pharmaceutical companies as possible until new medicine discount agreements come into force. A discount agreement under the approval model for the aforementioned substance will come into force for the first time on 01.10.2026 and will end on 30.09.2028. It will automatically end with the entry into force of the exclusive contract, regardless.
