Establishment of a Dynamic Purchasing System (DPS)

The DPS will be set up in two phases:

1. Establishment and management of a tenderer pool

The DPS will be established for the duration and scope of medical devices as mentioned in section 1.2. The procedure will be conducted exclusively electronically. The contracting authority will form a tenderer pool.

Any interested party can activate participation in the procedure at any time during the DPS and submit an application to participate. Any interested party who meets the suitability criteria published in the notice will be included in the tenderer pool and thus become a potential tenderer and can submit a bid in the subsequent single procurements.

The tenderer pool is not size-limited. Any qualified participant will be included in the tenderer pool.

2. Bidding phase

The specific procurements will be carried out as needed by the contracting authority during the bidding phase in the form of single procurements. The contracting authority decides on the timing or the number of single procurements. It is expressly stated that there is no obligation for the contracting authority to carry out single procurements.

On the occasion of the single procurement, the contracting authority invites all participants of the tenderer pool admitted for the DPS to submit a bid and informs them of the specific conditions of the contract (e.g. quantity, delivery time, delivery place, award criteria, etc.), unless these have already been published in the notice. By submitting a bid, the tenderer declares that there are no changes in the suitability criteria. The bids received will be examined in terms of content and on the basis of the published award criteria. The tenderer with the most economically advantageous bid, as determined on the basis of the communicated award criteria, will be awarded the contract.

Participants admitted to the tenderer pool of the DPS are not obliged to submit a bid as part of the single procurements. Participants must always inform themselves about the current status of the procurement procedure (the single procurement). Any deadline extensions, candidate questions with the corresponding answers or other updates and changes must be retrieved by the participant independently on the e-procurement platform of the Federal Government. Any changes will be announced immediately by the contracting authority.
