The subject of the contract is the supply of biochemical reagents and reagents for immunochemical assays, along with the lease of an integrated biochemical-immunochemical system. The quantities are included in Annex No. 1 to the SWZ – Tender Form. The Form of the Specification of the Minimum Required Parameters of the Device is Annex No. 2 to the SWZ. The detailed conditions for the implementation of the subject of the contract are specified in the contract project constituting Annex 3 to the SWZ. Pursuant to Article 441 of the Pzp, the purchaser envisages an option with a maximum value of 40%, i.e. it allows for the possibility of increasing the supply of the subject of the contract by up to 40% in relation to the basic scope, in the event of increased demand, for example, due to an increase in the number of patients, increased frequency of use of the subject of the contract, in the event of delays or prolonged procedures related to the preparation, conduct or completion of the next procedure for the award of a contract in the scope identical to the subject of this procedure or in any other case that the purchaser could not foresee. The purchaser also reserves the right that the Contractor has no claim against the purchaser in the event that the purchaser does not exercise the option. The purchaser also reserves the right not to implement up to 30% of the subject of the contract, in which case the Contractor may only demand remuneration due for the performance of the corresponding part of the contract, without any penalties or claims arising from this. The minimum value of the contract that will be performed is 70% in relation to the basic scope of the contract.
