Poland – Electricity – Dostawa i odkup energii elektrycznej dla Gminy Sosnowiec.

The subject of the contract is the supply of electrical energy and the purchase of electrical energy generated in renewable energy sources installations belonging to the Contracting Entities, carried out in accordance with the Energy Law, the Renewable Energy Sources Act, applicable implementing regulations, and quality standards for customer service. The detailed list of energy take-off points, RES installations, and the forecasted volume of electrical energy covered by the contract is contained in Annex No. 2 to the SWZ – "Description of the Subject of the Contract EE 2027-2028".

2. The subject of the contract includes:

1) supply of electrical energy to the energy take-off points of the Contracting Entities,

2) purchase of electrical energy generated and fed into the grid from the Contracting Entities' RES installations,

3) settlement of electrical energy according to four groups of recipients specified in the table below, for which the Contractor is obligated to offer separate unit prices for electrical energy applicable in 2027 and 2028 respectively.

Group 1 Street lighting

All street lighting and traffic signalization objects whose operation is automatically controlled. The objects may belong to the OSD tariff groups: Oxx, Cxx, R

Group 2 Premises and objects other than street lighting

All remaining objects not included in Group 1. The objects may belong to the OSD tariff groups: Cxx

Group 3 Objects supplied from the SN network

All remaining objects not included in Groups 1 and 2 belonging to the OSD tariff groups: Bxx

Group 4 Objects supplied from the Gxx tariff group

All remaining objects not included in Groups 1-3 belonging to the OSD tariff groups: Gxx

3. The forecasted demand for electrical energy in the period from 01.01.2027 to 31.12.2028, with a breakdown by tariffs, has been determined in the excel file marked: "Description of the Subject of the Contract EE 2027-2028"; sheet "Volume".

4. Purchase of electrical energy generated in RES installations

1) The contract also includes the reception and settlement of electrical energy fed into the distribution grid from renewable energy sources installations belonging to the Contracting Entity;

2) The Contractor will be obligated to enter into an agreement with the Contracting Entity regulating the rules for the purchase of electrical energy fed into the grid, in accordance with the requirements specified in this SWZ and Annex No. 5a to the SWZ "Minimum requirements for the electricity purchase agreement";

3) The Contractor is obligated to prepare a project of the electricity purchase agreement meeting the requirements specified in the SWZ and Annex No. 5a to the SWZ;

4) The method of settling electrical energy fed into the grid will depend on the legal status of the given RES installation and the applicable legal provisions.

5. Detailed conditions for the implementation of the contract The Contracting Entity has specified them in the draft provisions of the contract, constituting Annex No. 5 to the SWZ – PPU.

6. Electrical energy distribution services will be provided on the basis of separate agreements concluded between individual Contracting Entities (recipients/payers) and the relevant distribution system operator (OSD).
