Poland – Snow-clearing services – Zimowe utrzymanie jezdni dróg powiatowych – II – VI standard na sezon 2026/2027

The subject of the procurement is the services known as Winter maintenance of county roads – II – VI standard for the 2026/2027 season. The subject of the procurement is services related to the winter maintenance of county roads in Pilski County, including: clearing snow from the surface, removing slipperiness (black ice) in II, III, IV, V and VI standards of winter road maintenance included in the Winter Road Maintenance Plan for Pilski County for the 2026/2027 season, which is Annex 3 to the SWZ. 2. The detailed description of the subject of the procurement is Annex 3 to the SWZ. 3. The services within the scope of the procurement subject must be performed in accordance with the applicable legal provisions specified in, among others: 1) the regulation of the Minister of the Environment of 27 October 2005 on the types and conditions of use of means that can be used on public roads as well as streets and squares (Journal of Laws 2005, No. 230, item 1960). On public roads and streets, chemical agents should be used in the least harmful way to green areas and trees. The surface should be mechanically cleared of snow before sanding or applying chemical agents; 2) the Act of 16 April 2004 on nature conservation (Journal of Laws 2024, item 1478). The use of chemical agents in a manner significantly harmful to green areas and trees is punishable by arrest or a fine. 4. The contracting authority specifies the requirements referred to in Article 95 of the Pzp Act. The contracting authority requires, pursuant to Article 95 of the Pzp Act, the employment by the Contractor or subcontractor, on the basis of an employment relationship, of persons performing the following tasks within the scope of the implementation of the procurement – operation of equipment engaged in carrying out works related to winter road maintenance, i.e.: operation of a snowplough, gritter, loader, light and heavy plough, excavator-loader. The method of verifying the employment of these persons and the contracting authority's powers in the scope of controlling the Contractor's compliance with the above requirements, as well as the sanctions for non-compliance with these requirements, are specified in Annex 5 to the SWZ – Draft provisions of the contract for the public procurement, which will be introduced into the text of this contract. 5. The contracting authority envisages the award of contracts referred to in Article 214(1)(7) of the Pzp Act within 3 years from the date of award of the main contract, up to 50% of the value of the main contract. The contract will involve the repetition of services of the same kind.
