Frame agreement for the supply of cast-iron brake blocks for locomotives, passenger and freight wagons up to a net framework value of 250 000 euros. The buyer undertakes to call off a commitment of net 192 500 euros from the full framework value during the validity of the contract. Expected quantities: M284 type brake block: 4 035 units, M320F type brake block: 2 000 units, K250 type brake block: 8 500 units, K320 type brake block: 300 units. The Invitation to Tender draws the attention of tenderers to the fact that if the technical specification refers to a specific make or origin, or to a specific process, which characterizes the products of a given economic operator or the services provided by it, or refers to a trademark, patent, activity, person, type or specific origin or manufacturing process, as well as to a standard, technical approval, technical specifications, technical recommendations, then the designation has been made only in the interest of clearly defining the subject, and the expression “or equivalent” must also be understood next to the designation. In the present invitation and in the procurement documents, the Invitation to Tender has provided the quantitative data in an informative manner, and the quantities of the products that will actually be ordered after the conclusion of the framework agreement may deviate from these expected quantities. The Invitation to Tender also draws the attention of T. Tenderers to the fact that the data determined as expected quantities serve the comparability of the tenders, and also form the basis for the financial cover available to the Invitation to Tender for the performance of the contract. In this respect, if the tender price formed by the unit prices (net euros/unit) offered by the tenderer for the individual cast-iron brake blocks and the expected quantities exceeds the financial cover determined by the Invitation to Tender during the preparation of the procedure (and can be justified in accordance with Kbt. 75. § (4) subparagraph), then the Invitation to Tender may declare the given part unsuccessful in accordance with Kbt. 75. § (2) subparagraph b) point.
