The present contract is established within the framework of a purchasing group consisting of the public bodies listed below, which have a hospital laundry activity and are named GROUPEMENT ACHAT TEXTILE SUD BRETAGNE INTERHOSPITALIER, « GATSBIH ». It is specified that the GCS Achats Santé Bretagne also acts as a purchasing central authority in accordance with its constitutive convention. Its role is specified below.

Article 1 Presentation of the purchasing central authority

In accordance with its statutes, the GCS Achats Santé Bretagne carries out the permanent activity of a purchasing central authority. The present contract falls within this framework, in which the following also intervene:

The GIP SILGOM, to which the GCS has given a mandate to coordinate the purchasing group. As coordinator, the GIP SILGOM is the contracting authority for the present contract within the limits of its attributions defined in Article 2.2.

The member establishments, members of the purchasing group listed in Article 2 below.

The beneficiary establishments, which are not members of the purchasing group but which benefit from its provision under the conditions defined in Article 3 below.

Article 2 Presentation of the purchasing group

This consultation falls within the framework of a purchasing group constituted according to the rules defined by Articles L2113-6 and L2113-7 of the Public Procurement Code and governed by a constitutive convention signed by its members. The purchasing group consists of the following establishments:

CH Centre Bretagne de Pontivy establishment support of the GHT CENTRE BRETAGNE and acting in its name and on behalf and for the account of the following establishments:

CH Guémené sur Scorff; MAS Guémené sur Scorff; GIP Blanchisserie interhospitalière de Cornouaille GIP Bretagne Santé Logistique; GIP SILGOM;

Article 2.1 Coordinator

The GIP SILGOM has been designated as the coordinator of the purchasing group. A single contract is concluded between the contractor(s) and all the members of the group, represented by the coordinator. In the award phase, the coordinator is responsible for:

Determining the award method and the appropriate award procedure to meet the identified need;

Drawing up the tender dossier in line with the purchasing policy established by the GCS;

Ensuring the publication of pre-information notices and public call for tenders;

Conducting the advertising and competitive tendering procedures;

Carrying out all necessary steps with the candidates and the unsuccessful tenderers;

Awarding, signing and notifying the contract.

In the execution phase, the coordinator is responsible for:

Making changes to the contract, in the form of an amendment or unilateral modification;

Making renewals of the contract;

Declaring the termination of the contract;

Organising execution monitoring with the contractor(s) of the contract;

Notifying the contractor(s) of any new provision of the contract within the framework of the purchasing central authority.

Article 2.2 Members

With the exception of the elements expressly listed in Article 2 above, the execution phase of the contract is the responsibility of each member or beneficiary establishment. By way of derogation from the applicable CCAG, the member establishments and the beneficiary establishments have the status of purchaser for the execution of the contract, in particular for:

The conclusion of subsequent contracts, issuing purchase orders or service orders;

Notification of all decisions relating to the execution of the contract as listed in the contract documents, with the exception of those expressly reserved for the Coordinator;

Verification, acceptance and receipt of supplies and services or works;

Receipt, processing and payment of invoices;

Application of contractual penalties.

Article 3 Provision by the purchasing central authority to beneficiary establishments

As a purchasing central authority, the GCS Achats Santé Bretagne can make the present public contract available to its beneficiary establishments, including those whose membership is subsequent to the signature of the contract. This provision is subject to the cumulative conditions below:

Geographical limit: establishments in the Brittany region

Material limit:

Public health, social and medico-social establishments and inter-hospital syndicates pending their transformation;

Private health, social and medico-social establishments of collective interest or non-profit-making;

Health establishments under the jurisdiction of the Service de Santé des Armées;

Health cooperation groups and social and medico-social cooperation groups;

Public interest groups and economic interest groups whose purpose concerns the health and/or medico-social field;

Federative entities of members belonging to the above-mentioned categories.

This provision is made by means of a request for provision accepted by the GCS Achats Santé Bretagne after the opinion of the Coordinator and notified to the contractor by the Coordinator. From the notification by the Coordinator of the request for provision, the beneficiary establishment becomes, for the present contract, a purchaser, under the same conditions as the member establishments of the purchasing group. The provision within the framework of the purchasing central authority does not constitute a modification of the Contract. It is an execution measure. It therefore does not give rise to a unilateral modification decision or to the conclusion of an amendment, except at the express request of the contractor. The Contractor is informed of each new provision by letter from the contracting authority (Coordinator), specifying in particular:
