The subject of the contract is: One-off delivery of small laboratory equipment for the needs of the units of the Medical University of Silesia in Wrocław. 2. The subject of the contract is described in detail in the Technical Information Sheet (Attachment No. 2 to SWZ part 1 - 3) and priced in the Price List (Attachment No. 3 to SWZ part 1 - 3). The Contracting Authority requires that the offered products meet the requirements set out in the Technical Information Sheet. The detailed terms and conditions for the implementation of the contract are specified in the Contract Template (Attachment No. 6 to SWZ). 4. By describing the subject of the contract, the Contracting Authority has listed the name of the manufacturer and the catalogue numbers of the laboratory equipment, in order to indicate the quality standards of the product and to precisely define the subject of the contract. In cases where the description of the subject of the contract indicates trademarks, patents or origin, source or a particular process that characterizes the products supplied by a specific Contractor, this means that the Contracting Authority cannot describe the subject of the contract in a sufficiently precise and understandable manner. In such situations, any references to trademarks, patents, origin, source or a particular process, should be read with the words “or equivalent”. 5. In accordance with Article 99(6) of the Public Procurement Law, the Contracting Authority allows for the submission of equivalent offers, i.e. offers with parameters and properties no worse than those specified by the Contracting Authority in the Technical Information Sheet (Attachment No. 2 to SWZ part 1 – 3). 6. In the case of offering a product other than that indicated by the Contracting Authority, the Contractor is obliged to prove in the offer that the supplies offered by it meet the requirements specified by the Contracting Authority by providing the name of the offered product, the name of the manufacturer and the catalogue number, or other features unambiguously indicating the offered products in the Price List constituting Attachment No. 3 to SWZ (part 1 - 3). Equivalent products must: 1) Have the same composition and features as the laboratory equipment specified in Attachment No. 2 to SWZ (part 1 - 3), 2) Have the same capacity and mass of packaging as the laboratory equipment indicated in Attachment No. 2 to SWZ (part 1 - 3).
