In the technical specification – Appendix No. 1, the contracting authority has specified the materials from which the furniture and equipment must be made, as well as specific colours. The furniture and equipment, which are the subject of the present order, are additionally required for the Cardiology Clinic. They must match in colour and design with the main renovation completed in the same clinic following a general order carried out in 2026, as well as match in design, colour, material and details with the already available furniture in this clinic, delivered and installed following a general order for furniture delivery for the same clinic, with UIN in CIS 00536-2026-0003. As a result of the completed renovation, floor coverings have been laid in a specific colour, walls and ceilings have been painted in a corresponding colour, and there are also colour-coordinated interior doors. It is necessary for the furniture, which is the subject of the present order, to match in design and colours with the already installed furniture, in order to achieve an aesthetically pleasing overall appearance of the clinic, and by specifying the material from which the furniture should be made – to achieve high quality, durability and longevity of these furniture items, in line with those already made and installed, as well as compliance with the existing furniture in the clinic made from the specific material indicated by the contracting authority. Due to the above-mentioned objective circumstances, which lead to the need to specify specific materials and colours, the contracting authority considers that the requirements formulated in this manner in the technical specification do not lead to an unjustified restriction of competition and/or unjustified advantage of participants. If anywhere in the documentation and technical specification a specific model, source, process, trademark, type, patent, origin, standard or production is indicated, the contracting authority, pursuant to Article 50(1) of the Public Procurement Act, will accept any offer where the participant proves with any relevant document that the solution proposed by them meets the requirements in an equivalent manner. The public procurement is not divided into separate positions. Taking into account the total value of all identical and similar deliveries, the contracting authority has determined the order of awarding the public procurement to be in accordance with Article 18(1)(1) of the Public Procurement Act – open procedure. In accordance with Article 46(1) of the Public Procurement Act, the contracting authority has assessed that the subject of the order should be awarded as a single indivisible position. The order represents a comprehensive process, including interrelated stages of manufacture/delivery, installation and warranty maintenance of the furniture, with the subject including the delivery and installation of similar types and a small number – 5 items of furniture. When dividing the activities, the subject of the order – the production, delivery, installation and warranty maintenance of the furniture, the subject of the present order between different contractors, the risk of errors, duplication, omissions, technical incompatibilities and the need for corrective actions is substantial and would lead to delays and increased cost of the order. Dividing the order would also lead to difficulties in warranty servicing. The deadline for completing the delivery and installation activities is within 30 calendar days from the date of receipt by the contractor of the contracting authority's letter of appointment to perform the activities under the order. A participant who proposes a deadline for the completion of the order longer than the maximum deadline of 30 calendar days will be excluded from participation in the procedure pursuant to Article 107(2)(2)(a) of the Public Procurement Act.
