I. The subject of this public procurement procedure is the purchase of a robotic surgery system, including equipment, ancillary devices, training, and warranty/maintenance services for the Wojewódzki Hospital im. Jana Pawła II in Bełchatów, in accordance with the detailed description of the required technical parameters of the medical equipment covered by the contract, which the Contractor is obliged to deliver, install and commission, in accordance with the contract subject description, which is Annex 2.1 to SWZ - Required Technical Parameters and Annex 2.2 to SWZ - Technical Parameters Subject to Evaluation in the Tender Evaluation Criteria (if applicable). II. WARRANTY PERIOD: 60 months. The Contractor provides a quality warranty and guarantees against defects for a period of 60 months, counted from the date of signing the final acceptance protocol of the contract subject. The detailed conditions regarding the warranty and guarantee are specified in the Draft Contract Clauses, which is Annex 4 to SWZ. III. EQUIVALENCE - with regard to all the norms, European technical assessments, approvals, technical specifications and reference systems, and certificates indicated and required in the SWZ, the Purchaser accepts equivalent solutions. The names and trademarks provided by the Purchaser are exemplary, and their indication aims to define the expected standard. The Purchaser accepts the submission of equivalent tenders. The Purchaser will consider a "equivalent product" to be a product with no worse technical parameters than those indicated in the contract subject description. The Purchaser reserves the right that wherever in the documentation of the SWZ, constituting the contract subject description, trademarks, patents, or origin, sources, detailed processes or technologies that characterize the products or services supplied by a specific Contractor, norms, European technical assessments, approvals, technical specifications and technical reference systems have been indicated, the Purchaser accepts equivalent methods, materials, devices, systems, technologies, norms, specifications, etc. to those presented in the contract subject description. Therefore, it is possible to propose in the tender all equivalent market equivalents with properties no worse than those indicated by the Purchaser. The parameters of the indicated standard define the minimum technical, operational, user, quality, and functional conditions that the contract subject must meet. The indicated trademarks, patents, brands or manufacturer or source names or special processes, norms, European technical assessments, approvals, technical specifications and technical reference systems indicating origin, only define the class of products, methods, materials, devices, systems, technologies, norms, European technical assessments, approvals, technical specifications and technical reference systems, etc. In the tender, methods, materials, devices, systems, technologies, etc. of other brands and manufacturers can be accepted, but with technical, quality, and user and functional properties corresponding to the methods, materials, devices, systems, technologies, norms, European technical assessments, approvals, technical specifications and technical reference systems, etc. described in the SWZ. The Purchaser emphasizes that, in accordance with art. 101 para. 5 of the Pzp Act, the burden of proof that the tendered contract subject is equivalent, in relation to the requirements specified by the Purchaser in the SWZ, lies with the tendering Contractor. The general rules on equivalence have been specified in the Annex to the SWZ.
