Germany – Rolling stock – Rahmenvereinbarung II über die Lieferung von Schienenfahrzeugen an Unternehmen der NETINERA-Gruppe

NETINERA Deutschland GmbH, as the central procurement body for its affiliated companies, intends to conclude framework agreements with several companies for the supply of rail vehicles in two lots. Lot 1 includes rail vehicles with electric and/or battery-electric drives, as well as all forms of corresponding bimodal or hybrid vehicles (e.g. also in combination with diesel technology). These vehicles are intended for use in local rail passenger transport (SPNV) in Germany. Lot 2 includes rail vehicles of all drive types for use in medium- and long-distance SPNV services, particularly in the Czech Republic and Poland. The framework agreement (also referred to as a framework contract) authorises, but does not oblige, the railway transport companies belonging to the NETINERA Group to cover their need for rail vehicles in individual SPNV projects by concluding individual contracts. The award of the contract in the respective individual project will depend on the railway transport company receiving the award in a corresponding SPNV tender. The manufacturing companies with which a framework contract is concluded are also only authorised, but not obliged, to submit a corresponding offer in the respective individual project (bilaterally non-binding framework agreement). The framework agreements are limited to a total contract value of EUR 2.500 million in Lot 1 and EUR 1.000 million in Lot 2 (maximum value) and will lose their effect once this value is reached. The contracting authority expects an annual volume of approximately EUR 300 million in Lot 1 and approximately EUR 50 million in Lot 2 (estimated value). The procurement procedure is subject to Regulation (EU) 2022/2560 and bidders are subject to the notification requirement under Article 29 of the Regulation.
