Poland – Repair and maintenance services of medical equipment – Świadczenie usług serwisowych urządzeń diagnostycznych producenta OLYMPUS będących na stanie Specjalistycznego Szpitala im. dra Alfreda Sokołowskiego w Wałbrzychu na okres 36 miesięcy.

The subject of the contract is the provision of service for diagnostic devices produced by OLYMPUS, which are in the inventory of the Specialised Hospital named after dr. Alfred Sokołowski in Wałbrzych, for a period of 36 months. A further and detailed description of the subject of the contract is included in Annex 1 to the Specification of Contract Conditions (hereinafter: SWZ). 1. The works to be carried out under the contract involve maintaining the full technical and operational efficiency of the diagnostic devices and include: • repairs will be carried out as needed by the customer • periodic and preventive inspections as specified by the manufacturer, including: - diagnostics and repairs including replacement of damaged parts, - backup devices for the duration of the repairs: Annex 1 to the application: item 1 to 21, item 27 to 39, item 46 to 54 - emergency visits, - technical support and remote service, - updates, - audits - travel - software and construction modifications recommended by the manufacturer, improving performance and safety - service of the entire Endobase IT system in the scope of: periodic inspections, repairs, upgrade within the license - equipment under the manufacturer's warranty: Annex 1 to SWZ: item 11, 28, 29, 63, 64, 72, 73, 74, 106, 107 - warranty until 27.11.2027 item 40 - warranty until 01.06.2027 item 19 warranty until 09.01.2028 item 20, 21, 32, 33, 49 warranty until 25.11.2028. These items will automatically be covered by the service contract upon expiry of the warranty. The contractor declares that it has the appropriate qualified staff for the above scope of the contract description. The scope of work is dependent on the requirements of the medical device manufacturer. Certification in accordance with the manufacturer's declaration. Parts used for repairs must be factory new and approved for use by the device manufacturer. 2. The contractor will provide service for medical equipment and staff with qualifications and professional experience specified by the manufacturers (importers, distributors) in accordance with the Act of 7 April 2022 on medical devices, documented by a certificate. 3. The provision of services must be carried out in accordance with the manufacturer's requirements specified in the user instructions, applicable standards, instructions and relevant regulations, with observance of OH&S and fire safety regulations, in particular in accordance with the Act of 7 April 2022 on medical devices. 4. The contractor, together with the Customer's Representative, is obliged to keep documentation at the Customer's premises, specifying the dates of the next inspections, maintenance and service actions, resulting from the user instructions and the manufacturer's recommendations (scheduled part replacements, inspection kits). 5. The performance of a technical inspection must be confirmed by an appropriate entry in the technical passport together with the legible signature of the contractor and the issuance of a service protocol (work card) with a full description of the work. 6. The customer envisages the obligation arising from Article 95 of the Pzp Act in the form of employment under an employment contract within the framework of the implementation of the Contract of a person performing activities within the scope of the implementation of the subject of the contract. Detailed rules for documenting employment as well as the rights and obligations of the Parties are contained in the Draft Contract Provisions constituting Annex 3 to the SWZ. Attention!!! - Before concluding the contract, the Customer will require the most advantageous Contractor to provide a completed questionnaire for assessing the data processing entity acting on behalf of the administrator (Annex 11 to the SWZ), the decision will be made by the Customer after assessing the Contractor's offer. - The draft contract for data processing on behalf of the administrator will be finalised after the contractor has been selected.
