2.1.1. Procurement of goods, services and works

The procurement of goods, services and works is governed by the Public Procurement Act, which applies to all public authorities and other bodies that are subject to the Act. The Act provides a framework for the procurement of goods, services and works, including the rules for the award of contracts and the procedures for the selection of suppliers. The Act also sets out the rules for the publication of notices in the Official Journal of the European Union (OJEU) and the Tenders Electronic Daily (TED) database.

The procurement process is divided into several phases, including the preparation phase, the tendering phase, the award phase and the contract management phase. Each phase has its own specific requirements and procedures, which must be followed in order to ensure a fair and transparent procurement process.

2.2. Preparation phase

The preparation phase is the first phase of the procurement process and involves the identification of the needs of the contracting authority, the preparation of the procurement strategy and the preparation of the tender documents. During this phase, the contracting authority must ensure that the procurement process is in compliance with the Public Procurement Act and other relevant legislation.

The preparation phase includes the following steps:

- Identification of the needs: The contracting authority must identify the needs that the procurement is intended to meet. This includes the specification of the goods, services or works required, the quantity and quality of the goods, services or works, and the delivery or performance period.

- Preparation of the procurement strategy: The contracting authority must prepare a procurement strategy that outlines the approach to be taken for the procurement. This includes the selection of the most appropriate procurement procedure, the setting of the evaluation criteria and the preparation of the tender documents.

- Preparation of the tender documents: The tender documents must be prepared in accordance with the requirements of the Public Procurement Act and other relevant legislation.
