Acquisition of medical equipment 9 lots Suspensive clause (Lot 1-7): “The procedure for awarding the public procurement contract is initiated under the present suspensive clause, in the sense that the conclusion of the public procurement contract is conditional on the allocation of budgetary credits for this purpose, the contract being signed in compliance with the provisions relating to the commitment of expenditure from budgets subject to public finance legislation. In view of the provisions of Law 98/2016 on public procurement and H.G. no. 395/2016, as amended and supplemented, the Contracting Authority specifies that it will conclude the contract with the bidder declared the winner only to the extent that the funds necessary for the acquisition will be secured through the allocation of budgetary credits for this purpose. In the event that, for whatever reason, the budgetary credits are not allocated, for a period of 18 months from the date of approval of the procedure report, the award procedure will be automatically cancelled, on the condition that there is no other source of funding, in accordance with the provisions of Article 212 (1) lit. c) para. 2 of Law 98/2016, as amended and supplemented, making it impossible to conclude the public procurement contract. Bidders within this procedure understand that the Contracting Authority cannot be considered responsible for any prejudice in the event of cancellation of the award procedure, regardless of the nature of the prejudice and regardless of whether the Contracting Authority has been notified of the existence of such prejudice. Bidders within this procedure accept the use of the above special conditions/suspensive clause, assuming full responsibility in relation to any prejudice they may suffer in the described situation. The maximum period for which the suspensive clause applies is 18 months, so that, in the event that the condition relating to the securing of financing is not met, the award procedure is cancelled.
