The products to be purchased under the framework agreement, further quality and functional requirements are detailed in the technical description and detailed price list forming part of the procurement documents. Only a complete offer can be made for the whole part. The bidder must make an offer for each line of the price list. The procurement includes delivery. The contracting parties agree to establish a purchase right for 30% of the total quantity (calculated for 24 months) of all products and an optional lease right for 30% of the total quantity (calculated for 24 months) of all movable property. The buyer may exercise the purchase right or optional right by unilaterally notifying the seller at least 30 days before the expiry of the contract. In order to clearly and unambiguously define the subject of the procurement, the Inviting Entity may, pursuant to paragraph (3) of section 46 of Government Decree 321/2015 (X. 30.), refer in the invitation to tender and the procurement documents to a product, origin, type of thing, process, activity, person, patent or trademark. In each such case, the reference is made solely for the purpose of clearly defining the nature of the subject matter, and a tender may be submitted for a product that meets the requirements set out in this invitation to tender, or that is equivalent to it in terms of the detailed technical parameters relating to the given product. The Inviting Entity shall assess the equivalence during the evaluation of the technical content, for which the Bidder must provide all data. The Bidder is therefore obliged to prove in the tender that the offered product is equivalent to the product defined by the Inviting Entity. Any rejection must be substantively justified by the Inviting Entity. The Inviting Entity may also submit a tender for a product with more favourable characteristics than those prescribed. With regard to the proof of equivalence, Government Decree 321/2015 (X. 30.) sections 46. (4)-(6) are applicable.
