In accordance with paragraph 3 of Article 46 of the R., the AK draws attention to the fact that if the unambiguous and generally understandable definition of the subject of the procurement requires reference to a specific brand, origin, type of item, procedure, activity, person, patent or trademark, the mention is made only in the interest of unambiguously defining the subject matter, and in all cases the phrase "or equivalent" must be understood in addition to the mention.

The AK draws attention to the fact that in the case of an equivalent item being offered, the equivalence must be proven by the bidder in the tender.
