1) Service for the collection and disposal of waste with code 19 05 99 – other unspecified waste (so-called stabilizate), which is produced in the process of biological treatment of waste with code 19 12 12 other waste (including mixed substances and objects) from mechanical processing of waste other than those mentioned in 19 12 11 – fraction 0-80, along with the service of transporting waste from RZUOK in Machnacz, gm. Brześć Kujawski. 2) The total estimated amount of waste with code 19 05 99 planned for collection, transport and disposal, from the date indicated by the parties in the contract to 31.12.2027, is approximately 8,000 Mg. 3) The estimated amount of waste planned for collection, transport and disposal per month is approximately 533 Mg. The monthly estimated amount of waste planned for collection may change depending on the needs of the Purchaser. 4) The disposal of the collected waste with code 19 05 99 must be carried out in accordance with the requirements set out in the Act of 14 December 2012 on waste (Dz.U. 2023 poz. 1587 ze zm.), in the process of recovery and/or disposal in the facility indicated by the Contractor in the tender form. 5) The Purchaser informs that it has conformity tests for waste with code 19 05 99 prepared in accordance with Annex No. 3 to the Regulation of the Minister of Economy of 16 July 2015 on the admission of waste to landfills (Dz.U. 2015 poz. 1277 t.j.) Additionally, in accordance with the Regulation of the Council of Ministers of 22 December 2017 on individual rates of charges for the use of the environment (Dz.U. 2017 poz. 2490 ze zm.) we carry out AT4 tests, burning losses and organic carbon content. The tests and analyses mentioned above, as well as the Waste Characteristic Card, will be made available to the contractor before the signature of the contract for the public procurement. 6) In the case of disposal of waste by landfilling, the disposal entity must have the status of a communal installation as referred to in Article 35(6) of the Waste Act (to be on the list of the Marshal of the Voivodeship as referred to in Article 38b(1) of the Act of 14 December 2012 on waste). 7) The Contractor is obliged to indicate in the tender form the process of recovery and/or disposal, in accordance with Annex No. 1 and/or Annex No. 2 of the Act of 14 December 2012 on waste (Dz.U. 2023 poz. 1587 ze zm.), to which the waste collected from the Purchaser will be subjected, together with the indication of the name and address of the installation/plant, to which the waste will be directed, with the proviso that in the case of disposal of waste in the disposal process, this waste should be transferred to a communal installation in accordance with Article 38b(1) of the Act of 14 December 2012 on waste. 8) The transport of waste must be carried out in accordance with the requirements set out in the Regulation of the Minister of the Environment of 7 October 2016 on detailed requirements for the transport of waste (Dz. U. z 2016 poz. 1742 ze zm.). 9) The waste will be handed over in bulk. The loading of waste is the responsibility of the Purchaser and will be carried out using a wheel loader with a bucket capacity of over 3 m3 and a loading height of 4.30 m. 10) Each collection of waste will be carried out by weighing the collected waste on the Purchaser's legalised scale, located in RZUOK in Machnacz 41a, which will be confirmed by a weighing ticket. This document will constitute the basis for determining the amount of waste collected by the Contractor and the basis for settlement. 11) The Purchaser will be obliged to issue waste transfer cards in the electronic waste database, in which the entity transporting the waste and the installation to which the waste will be transferred will be indicated. The entity receiving the waste will be obliged to confirm the above cards each time. The cards will be issued in accordance with the provisions of the Act of 14 December 2012 on waste (Dz.U. 2023 poz. 1587 ze zm.). 12) The collection of waste will take place successively on weekdays from Monday to Friday, from 7:00 to 20:00, after the Purchaser sends a collection order, taking into account the size of the batch for collection, which will be no less than 22 Mg and no more than 25 Mg, but no later than within 3 working days (the response time will constitute a criterion for evaluating tenders in accordance with Section XXII SWZ) from the date of notification by the Purchaser. The Purchaser will specify the amount of waste to be collected in each collection order mentioned in the first sentence. The parties allow for the possibility of changing the amount of waste to be collected, which will not affect the collection time, mentioned in the first sentence. The orders mentioned above will be made electronically to the Contractor's e-mail address. 13) The place of collection of waste is: Regionalny Zakład Utylizacji Odpadów Komunalnych w Machnaczu 41a, gm. Brześć Kujawski (województwo kujawsko - pomorskie). 14) In order to ensure the continuity of the collection of waste, which is the subject of the contract from RZUOK in Machnacz, gm. Brześć Kujawski, the Contractor is obliged to start collecting waste within a maximum of 5 working days from the date of the contract coming into force. 15) The Purchaser reserves the right to reduce the amount of waste, mentioned in point 2) above, by 60%. In such a situation, the Contractor does not have the right to claim: - the amount due for the uncollected amount of waste, - compensation for lost profits.
