(Numeracja zgodna z SWZ) 4.DESCRIPTION OF THE CONTRACT 4.1. The subject of the contract is the provision of cleaning services in the office premises belonging to the Miejski Ośrodek Pomocy Społecznej in Łódź in 2027. 4.2. A detailed description of the subject of the contract is provided in Annex 1 to SWZ (description of the subject of the contract) and in Annex 8 (contract template). 6. CONTRACT PERFORMANCE TERM The contract performance term: from the date of signing the contract, but no earlier than 04.01.2027, to 31.12.2027. 8.INFORMATION ON THE CONDITIONS FOR PARTICIPATION IN THE PROCEDURE FOR AWARDING THE CONTRACT 8.1. Contractors who meet the following conditions may apply for the award of the contract: 8.1.1.capacity to operate in the economic market: The contracting authority does not specify any requirements in this regard that the contractor is obliged to demonstrate in a specific manner. 8.1.2.entitlement to carry out a specific economic or professional activity, if this results from separate provisions: The contracting authority does not specify any requirements in this regard that the contractor is obliged to demonstrate in a specific manner. 8.1.3.economic or financial situation: The contracting authority does not specify any requirements in this regard that the contractor is obliged to demonstrate in a specific manner. 8.1.4.technical or professional capacity: The contracting authority does not specify any requirements in this regard that the contractor is obliged to demonstrate in a specific manner. 9. LIST OF SUBJECTIVE EVIDENTIAL MEANS AS WELL AS OTHER DOCUMENTS Pursuant to Article 139(1) of the Pzp Act, the contracting authority will first carry out an examination and evaluation of the offers, and then qualify the contractor, whose offer was rated highest, in terms of the absence of grounds for exclusion and the fulfilment of the conditions for participation in the procedure. 9.1.List of declarations and documents that the contractor submits together with the offer: 9.2. THE CONTRACTOR IS REQUIRED TO SUBMIT, in order to preliminarily confirm that it is not subject to exclusion and meets the conditions for participation in the procedure: 9.2.1.Declaration on the division of obligations during the implementation of the contract – the template for the declaration is Annex 6 to SWZ; 9.2.2.Declaration of the contractor regarding the grounds for exclusion under Article 5k of Regulation 833/2014 concerning measures restricting in connection with the actions of Russia destabilising the situation in Ukraine and Article 7(1) of the Act on special solutions in the field of counteracting the support of aggression on Ukraine and serving to protect national security, submitted pursuant to Article 125(1) of the Pzp Act, in accordance with the template constituting Annex 5 to SWZ (signed with a qualified electronic signature). In the case of contractors jointly applying for the contract, this declaration is submitted by each of these contractors (this also applies to partners of a civil law partnership). 9.3. PURSUANT TO ARTICLE 139(1) AND (2) OF THE PZP ACT, AT THE REQUEST OF THE CONTRACTING AUTHORITY, THE CONTRACTOR, whose offer was rated highest, is obliged to submit, within the specified period (not shorter than 10 days), subjective evidential means and the European Single Procurement Document (hereinafter: ESPD) current as of the date of submission, i.e.: 9.3.1. In order to confirm that the contractor meets the conditions for participation in the procedure and there are no grounds for exclusion from the procedure for awarding the contract to the contractor, the contracting authority requires the following documents: 9.3.1.1.current declaration regarding the absence of grounds for exclusion from the procedure and the fulfilment of the conditions for participation in the procedure in the form of the European Single Procurement Document (ESPD/JEDZ) – Annex 3 to SWZ (file in XML format). 9.3.2. In order to demonstrate the absence of grounds for exclusion from the procedure for awarding the contract to the contractor, the contracting authority requires the following documents: 9.3.2.1.Declaration of the contractor under Article 108(1)(5) of the Pzp Act on the absence of affiliation with the same capital group in the sense of the Act of 16 February 2007 on the protection of competition and consumers (i.e. Journal of Laws of 2025, item 1714) with another contractor who submitted a separate offer, or a declaration of affiliation with the same capital group together with documents or information confirming the preparation of the offer independently of another contractor belonging to the same capital group – the template for the declaration is Annex 7 to SWZ. 9.3.2.2. Declarations of the contractor regarding the currency of the information contained in the declaration, namely: 9.3.2.2.1. Article 125(1) of the Pzp Act (i.e. in the single document ESPD) in the scope relating to the grounds for exclusion indicated in Article 108(1)(3) – 6 of the Pzp Act, 9.3.2.2.2. Article 5k of Regulation 833/2014 as amended by Regulation 2022/576 and Article 7(1) of the Act on special solutions in the field of counteracting the support of aggression on Ukraine and serving to protect national security, each of these entities also submits – template Annex 4 to SWZ. 9.3.2.3. Information from the National Criminal Register in the scope relating to the grounds for exclusion specified in Article 108(1)(1), (2), (4) of the Pzp Act, prepared no earlier than 6 months before its submission.
