2. PROCEDURE FOR AWARDING THE CONTRACT

2.1. The procedure is conducted as an unrestricted tender procedure in accordance with Article 377, paragraph 1, point 1, and Articles 132-139 in conjunction with Article 378, paragraph 1 of the Act of 11 September 2019 on Public Procurement (Journal of Laws of 2026, item 793 with amendments – “PZP”) and the implementing acts to PZP.

2.2. The procedure is conducted in accordance with the rules provided for sectoral procurement with a value equal to or exceeding the EU thresholds.

2.3. The procedure is conducted in accordance with the rules provided for the so-called “reverse procedure”, as mentioned in Article 139, paragraphs 1, 3 and 4 of PZP. According to the cited provisions, the Contracting Authority first conducts an examination and evaluation of the tenders, and then conducts a subjective qualification of the Contractor whose tender was highest evaluated, in terms of the absence of grounds for exclusion and the fulfillment of the conditions for participation in the procedure.

2.4. The Contracting Authority does not provide for the selection of the most advantageous tender using an electronic auction.

2.5. The Contracting Authority does not allow the submission of variant tenders and does not provide for the conclusion of a framework agreement.

2.6. The Contracting Authority, pursuant to Article 131, paragraph 2, point 1 and Article 134, paragraph 2, point 9 of the PZP Act, requires the submission of a tender after the Contractor has conducted a site visit of all SUW indicated in Annex 4 to the contract template. The tender of a Contractor who has not completed the required site visit will be rejected pursuant to Article 226, paragraph 1, point 18 of the PZP Act. The site visit will take place after prior agreement on the date with the Contracting Authority. The registration should be sent by email to: [email protected], indicating: 1. the name of the Contractor, 2. the first and last name of the contact person and phone number, 3. the first and last names of the persons who will participate in the site visit. The Contracting Authority will agree with the Contractor on the date of the visit in a manner that ensures the continuity and uninterrupted operation of the facilities. The Contractor is obliged to comply with the instructions of the Contracting Authority's employees regarding the organization of the visit, safety, and movement within the facilities. Confirmation of the site visit will be a protocol signed by a representative of the Contractor and the Contracting Authority or a list of attendance covering all the facilities where the visit was conducted. During the site visit, it is not allowed to take photographs or audio or video recordings. The site visit does not serve to provide explanations regarding the contents of SWZ. Questions regarding the contract documents should be directed in the manner specified in SWZ. The Contracting Authority reserves the right to set a common date for the visit for several Contractors or to indicate time intervals in which the visits can be conducted. No more than 2 representatives of a given Contractor may participate in the site visit. The Contracting Authority has decided not to divide the material scope of the contract subject, as all the facilities covered by it are closely related and, as components of the water supply system, must be operated by one Contractor who will be responsible for the quality of the water supplied.

3. DESCRIPTION OF THE CONTRACT SUBJECT

3.1. The subject of the contract is the operation and maintenance of the technological sequence of devices included in the municipal water production system and the operation of the water supply network (including connections) in the municipality of Jarocin.

3.2. A detailed description of the contract subject is included in the contract template constituting Annex 9 to SWZ.

3.3. Common Procurement Vocabulary (CPV): 65111000-4 – Water supply, 65130000-3 – Water station operation.

3.4. The Contracting Authority does not reserve the obligation for the Contractor to personally perform key tasks related to the contract subject. The Contractor may entrust the implementation of elements (parts) of the contract subject to subcontractors. In the event of an intention to perform the contract subject with the involvement of subcontractors, the Contractor is obliged to indicate in his tender the part of the contract (material scopes) whose implementation he intends to entrust to subcontractors, and to provide the names of potential subcontractors, if known. In the absence of an indication in the Tender of subcontracting, the Contractor will only be able to introduce a subcontractor on the terms specified in the contract.

3.5. The Contracting Authority requires the Contractor or subcontractor to employ, under an employment contract, persons performing activities consisting of: operating the technological sequence of devices included in the municipal water production system and operating the water supply network (including connections). Before concluding the contract, the Contractor undertakes to submit a written statement in which he confirms that all persons performing activities within the scope of implementing the Contract Subject, as mentioned in point 3.5, will be employed, for the entire period of performing these activities, on the basis of an employment contract.

3.6. The Contractor selected as a result of this procedure is considered the waste producer – within the meaning of the provisions of the law.
