Polen – Personensonderbeförderung (Straße) – Usługa przewozu osób z niepełnosprawnościami na terenie Gminy Miejskiej Kraków

1. Name of the contract: „Transportdienst für Personen mit Behinderungen im Gebiet der Stadtgemeinde Krakau”. 2. The subject of the contract is the transport of persons with disabilities residing in the area of the Stadtgemeinde Krakau according to the terms specified in the contract template and its annexes (especially Annex No. 2 to the contract template, i.e. the regulations for the transport of persons with disabilities). The transport is carried out exclusively within the area of the Stadtgemeinde Krakau. The scope of transport to be performed is estimated at approximately 816 000 kilometres of transport, including: - year 2026 – 34 000 kilometres of transport, - year 2027 – 408 000 kilometres of transport, - year 2028 – 374 000 kilometres of transport. By transport is meant a journey with at least one eligible person with a disability. 3. The contractor is obliged to have and maintain throughout the period of implementation of the subject of the contract an appropriate civil liability insurance policy in the scope of the conducted activity related to the subject of the contract, in the amount of insurance of at least 600 000,00 zł, which will be presented upon conclusion of the contract. 4. The detailed description of the subject of the contract contains the contract template together with the annexes constituting Annex No. 12 to SWZ. The contracting authority does not allow the submission of partial offers, the reason for not dividing the contract into parts has been indicated in point 3.6. SWZ. 5. The contracting authority does not require the implementation of the contract by sheltered workshops, social cooperatives, or other contractors covered by the provisions of art. 94 para. 1 of 11 September 2019 – Public Procurement Law (i.e. Journal of Laws of 2026 item 793 with later amendments), hereinafter referred to as the „Act”. 6. The contracting authority, pursuant to art. 95 para. 1 of the Act, requires the employment, for the entire period of implementation of the subject of the contract, on the basis of an employment relationship, by the Contractor (or subcontractor) of at least two persons in dispatcher-coordinating positions. The performance of these tasks involves providing work in the manner specified in art. 22 § 1 of the Act of 26 June 1974 – Labour Code (i.e. Journal of Laws of 2026 item 1245). Persons employed in dispatcher-coordinating positions must use the Polish language at least at a communicative level. Notice! The above requirement does not apply to: natural persons conducting business activity, who will commit to providing the above-mentioned services personally and partners of personal companies, who will commit to providing these services personally on behalf of the company. 7. The contracting authority envisages the possibility of awarding contracts, as referred to in art. 214 para. 1 point 7 of the Act, in an amount not exceeding 120% of the value of the basic contract. These contracts will involve the repetition of similar services in relation to those described in this procedure in the contract template and its annexes. The conditions on which the above-mentioned contracts will be awarded will correspond to the conditions specified in this procedure in the contract template and its annexes, however, the conditions for participation in the procedure will be limited relevantly to the repeated scope of the contract. In this regard, the contracting authority, when determining the value of this contract, took into account the value of the contracts, as referred to in art. 214 para. 1 point 7 of the Act, in the amount of: 9 204 480,00 zł netto. Notice! The estimated value of the contract indicated in point 2.1.3. of the notice includes the value of the expected contracts, as referred to in art. 214 para. 1 point 7 of the Act in the amount of 9 204 480,00 zł netto. 8. The contracting authority does not require contractors to submit substantive evidence in this procedure. 9. The contracting authority does not envisage the conduct of an electronic auction. 10. The contracting authority conducted preliminary market consultations before initiating the procedure. 11. The contracting authority, within the limits set by art. 462 and subsequent of the Act, allows the possibility of implementing the subject of the contract by the contractor using subcontractors. A contractor who intends to entrust the performance of part of the contract to subcontractors indicates in the offer the parts of the contract which he intends to entrust to subcontractors, and provides the names of any potential subcontractors, if they are already known. 12. The contracting authority does not require the submission of an electronic catalogue in this contract, in the sense of art. 93 of the Act. 13. The justification for the application of the criterion price 100% was indicated in point 3.16 SWZ. 14. Notice! The correct description of the position entitled "electronic catalogue" in point 5.1.12. of the notice is: The contracting authority does not require the submission of an electronic catalogue in this contract, in the sense of art. 93 of the Act. 15. The contracting authority indicated the correct deadline for the submission and opening of offers in point 5.1.12. of the notice, without the "+02:00" entry imposed by the system.
