Description

The subject of the procurement is the comprehensive supply of electricity, including the sale of electricity and the provision of distribution services by the relevant distribution system operator (PGE Dystrybucja S.A.), from 1 January 2027 to 31 December 2027, to 321 ordering entities listed in Section I – buildings, street lighting, pumping stations, hydrofors and sewage treatment plants. 2. The basic forecast volume of the entire procedure (Q0) is 4 762 784 kWh, including 103 142 kWh in 7 PPE members of the Trzebownisko Energy Cooperative (hereinafter „SE”). The volume allocated to individual ordering entities is specified in Section I, point 2 and Part A of Annex No. 3 to the PPU. The forecast was established based on energy consumption from the grid according to OSD data for the period from 1 October 2025 to 30 September 2026, adjusted for photovoltaic installations commissioned in 2025–2026. The forecast of energy purchase from the contractor was adopted at the level of the forecast of consumption from the network: installations settled in the system of opusts do not introduce energy into the network, in the net-billing system all energy consumed from the network is purchased, and the prosumer deposit serves to pay, and for PPE SE it was assumed that energy was purchased cautiously equal to consumption, because the start date and the result of the SE settlements are not certain (§ 10a para. 4 and 12 PPU). 3. The quantities of energy indicated in the SWZ and in the list of PPE are a forecast serving to compare offers and determine the value of contracts. Settlement takes place according to the actual consumption, based on OSD metering and settlement data. Each ordering entity guarantees the purchase of at least 70% of the volume Q0_POZA_SE assigned to it (in total for all contracts 3 261 749 kWh), and for PPE members of SE – covering all indicated PPE with the contract, without guaranteeing the amount of energy (§ 2 para. 4–5 PPU). The minimum may be reduced under the conditions of § 2 para. 4a PPU, if the PPE indicated in Annex No. 5 to the PPU are covered by SE settlements during the contract – at the planned date in this annex together by 95 270 kWh, and in no case by more than 157 500 kWh. 4. Energy cooperative. The procurement includes the comprehensive supply and settlement of 7 PPE members of SE (Gmina Trzebownisko – 4 PPE, GCK – 1 PPE, GBP – 1 PPE, OSP Jasionka – 1 PPE). According to art. 40 para. 1ac of the OZE Act, the selected contractor will be the sole seller settling SE and its members in the model referred to in art. 38c of the OZE Act, on the basis of § 10a PPU. The list of SE, its members, recipients and producers as well as the template of the agreement with SE is Annex No. 6 to the PPU, and the declaration of SE on readiness to conclude an agreement with the selected contractor – Annex No. 11 to the SWZ. 5. OZE installations. The ordering entities operate photovoltaic installations at 13 PPE (one during connection), including 4 installations in PPE members of SE and an energy storage facility with a capacity of 20.5 kWh in the building of the Trzebownisko Municipal Office. The list of installations, their parameters and settlement models (opust, net-billing, SE model or lack of prosumer settlement) is contained in Annex No. 2 to the PPU; OSD documents regarding micro-installations are Annex No. 10 to the SWZ. The Q0 forecast includes energy consumed from the network; production from installations was not deducted again from consumption. 6. The detailed description of the subject of the procurement is contained in Annex No. 9 to the SWZ (OPZ). The list of PPE with technical and commercial data (purchaser, recipient, NIP, current seller, type and date of termination of the contract, notice period, tariff group, contractual power, security, meter number, OSD reading cycle, forecasted consumption, SE status, planned start date) is Annex No. 1 to the PPU. 7. Current contracts. For 318 PPE, the current seller is Energa Obrót S.A., and comprehensive contracts are in force until 31 December 2026. For 3 PPE (GCK – Spichlerz Łąka, OSP Jasionka, ZGK), comprehensive contracts with PGE Obrót S.A. are in force for an indefinite period, with a 3-month notice period; the ordering entities have applied to PGE Obrót S.A. for the termination of these contracts by mutual agreement as of 31 December 2026; in the event of PGE Obrót S.A.'s disagreement, the contracts will be terminated, and supplies to these PPE will commence on the first day after the date of their termination (Annex No. 1 to the PPU, column „Planned start date”). The contractor, on the basis of powers of attorney granted according to the template constituting Annex No. 4 to the PPU, carries out the processes of changing the seller in CSIRE/OIRE or with OSD (§ 3 PPU). 8. General distribution agreement. The contractor ensures the valid general distribution agreement for the comprehensive service (GUD-K) with PGE Dystrybucja S.A. no later than before submitting the processes of changing the seller (§ 3 para. 3 PPU). Possession of GUD-K is a condition for the implementation of the contract, but not a condition for participation in the procedure; the selected contractor submits a declaration according to Annex No. 4 to the SWZ before concluding the contracts. 9. Quality standards relating to all essential features of the subject of the procurement, referred to in art. 246 para. 2 of the Pzp, are specified in point 18 of the OPZ. 10. Change of distribution parameters of PPE (contractual power, tariff group) during the contract takes place on the basis of § 4a PPU; fees provided for in the OSD tariff in connection with the change are borne by the ordering entity, without the contractor's margin. 11. The ordering entity does not allow the conclusion of a contract on the template of the contractor. The contractor's regulations and contract templates do not constitute part of the contract and cannot impose additional fees or obligations on the ordering entities (§ 17
