The procedure is conducted in accordance with the provisions of the Act of 11 September 2019 on Public Procurement (Journal of Laws of 2024, item 1320, as amended), hereinafter referred to as the Pzp Act. The procedure is conducted in the form of a restricted tender in accordance with Article 410(1) of the Pzp Act. The contract is classified as a procurement in the field of defence and security. The subject of the contract is a service of a critical nature in accordance with Article 7(13) of the Pzp Act, as it is a service intended for security purposes, involving the use of non-public information. At the same time, in accordance with Article 7(36)(d) of the Pzp Act, this service is intended exclusively for military purposes. The implementation of the SUFO service on the premises of a military unit requires the Contractor to work closely with materials classified at least as "confidential". The Contractor, based on an extract from the Military Complex Protection Plan, is obliged to develop and implement a Security Instruction, which in itself becomes a document containing sensitive data (e.g. the location of posts, communication systems, crisis response procedures). The tasks of the SUFO personnel do not limit themselves to guarding property, but also include the systematic protection of strategic objects. The Contractor processes non-public information relating to the security structure of the unit, alarm systems and restricted access areas. Furthermore, as part of the service provided, SUFO staff protect physical access to rooms and equipment where information of key importance to the country's defence is processed. Given the above, the Contractor is required to have the ability to protect non-public information, which confirms the nature of the service as going beyond the standard property protection services available on the civil market. The Purchaser does not envisage limiting the number of Contractors to whom it will invite to submit tenders. The Purchaser will invite all Contractors whose applications for admission to the procedure will not be rejected under Article 146(1) of the Pzp Act. The subject of the contract is: the provision of a security service for persons and property carried out by Special Armed Security Formations (SUFO) on a 24/7 shift system for the Representative Regiment, which is under the supply of the Purchaser (KW-7886, KW-4669). The detailed description of the subject of the contract is specified in: Annexes No. 12 and No. 13 to the SWZ, i.e. Description of the Subject of the Contract and Draft Contract Terms. The Purchaser requires the Contractor to employ, on the basis of an employment relationship, a person performing the tasks indicated by the Purchaser in the scope of the implementation of the contract: physical protection of persons and property, if the performance of these tasks involves work in the manner specified in Article 22(1) of the Act of 26 June 1974 - Labour Code. The method of verifying the employment of these persons and the Purchaser's rights in the scope of controlling the Contractor's compliance with the requirements related to the employment of these persons and the sanctions for non-compliance with these requirements are contained in Annex No. 13 to the SWZ, i.e. Draft Contract Terms. In the procedure for awarding the contract, communication between the Purchaser and the Contractors, in particular the submission of an application for admission to the procedure/tenders, the exchange of information and the transmission of documents or declarations, is carried out using electronic communication means provided by the System. The technical and organisational requirements for sending and receiving electronic documents and information transmitted using them are described in the Regulations for the use of the System's services (Regulations of the e-Services Portal) available from the E-learning module for all users of the System and during the registration of the Contractor's account for Contractors. 1) Applications for admission to the procedure/tenders, declarations submitted electronically must be signed with a qualified electronic signature. In the process of submitting an application for admission to the procedure/tender, declarations or relevant evidential means on the platform, the Contractor may submit a qualified electronic signature directly on the document, which is then sent to the System. The Contractor, Contractors jointly applying for the award of a public contract, in the scope of documents relating to each of them, certifies the conformity with the original. By original, a document signed with a qualified electronic signature by the person/persons authorised is meant. The certification of conformity with the original is made in electronic form signed with a qualified electronic signature by the person/persons authorised.
