Poland – Various medicinal products – Dostawa różnych produktów leczniczych, produktów leczniczych dla układu sercowo-naczyniowego, produktów leczniczych do leczenia zaburzeń w funkcjonowaniu przewodu pokarmowego, produktów leczniczych dla układu nerwowego, środków leczniczych dla układu oddechowego, środków przeciwbólowych, środków znieczulających, środków moczopędnych, dodatków mineralnych (...) w podziale na 47 cz.

The subject of the contract is the supply of various medicinal products, medicinal products for the cardiovascular system, medicinal products for the treatment of digestive tract dysfunctions, medicinal products for the nervous system, medicinal products for the respiratory system, pain relievers, anaesthetics, diuretics, mineral supplements, systemic antifungal agents, medicinal products for the musculoskeletal system, anticoagulants, haemostatic agents, medicinal products for blood and blood-forming organs, anticancer agents, systemic antibacterial agents, medicinal products for the digestive tract and metabolism, divided into 47 parts. The contractor may submit a bid for any part/parts or for the entire subject of the contract. The contracting authority does not allow the submission of alternative bids. The contracting authority – pursuant to Article 139 of the Public Procurement Law (PZP) – informs that it will first examine and evaluate the bids in this procedure for the award of a public contract and then qualify the contractor whose bid was most highly evaluated, in terms of the absence of grounds for exclusion and the fulfilment of the conditions for participation in the procedure. DOCUMENTS TO BE SUBMITTED WITH THE BID: 1. The bid consists of: 1) a completed tender form, in accordance with Annex 1 to the SWZ; 2) a completed assortment-price form, in accordance with Annex 2 to the SWZ. 3) a declaration indicated in Section V, paragraph 5, point 2 of the SWZ (if applicable). 2. The contractor must submit with the bid: 1) a copy or information from the National Court Register, Central Register and Information on Economic Activity or another relevant register – in order to confirm that the person acting on behalf of the contractor is authorized to represent it. The contractor is not obliged to submit these documents if the contracting authority can obtain them through free and publicly available databases, provided that the contractor indicates the data enabling access to these documents (original); 2) if the person acting on behalf of the contractor is not authorized to represent it as per the documents mentioned in the previous point: a power of attorney or other document confirming the authorization to represent the contractor; 3) a power of attorney to represent contractors jointly applying for the award of the contract - if applicable; 4) in the case of submitting a guarantee in a form other than monetary – the original of the guarantee document (guarantee or bond) – if applicable. 5) Declaration and documents indicated in Section VI A to the extent specified therein as to be submitted with the bid. SUBSTANTIVE EVIDENTIARY MEANS: 1. In the case of offering medicinal products covered by the Minister of Health's consent for temporary admission to the market, the contracting authority requires the submission of the Minister of Health's consent for the temporary admission of this medicinal product to the market, valid on the date of submission of the bid. 2. In the case where the contractor does not submit the substantive evidentiary means or the submitted substantive evidentiary means are incomplete, the contracting authority will call for their submission or completion within a specified deadline. Contractors may jointly apply for the award of the contract. In such a case: 1) the condition regarding the entitlement to conduct a specific economic or professional activity indicated in paragraph 1, point 2 is met if at least one of the contractors jointly applying for the award of the contract has the entitlement to conduct a specific economic or professional activity and will realize the deliveries for which these entitlements are required; 2) in the case referred to in point 1, the contractors jointly applying for the award of the contract attach to the bid a declaration from which it follows which deliveries will be made by the individual contractors, according to the template constituting Annex 5 to the SWZ. 3) the contractors are obliged to appoint a representative to represent them in the procedure for the award of the contract or to represent them in the procedure and conclude the contract for the public contract. The power of attorney should be submitted together with the bid. DECLARATION UNDER ARTICLE 125, PARAGRAPH 1 OF THE PZP: 1. Before selecting the most advantageous bid, the contracting authority will call the contractor whose bid was most highly evaluated to submit, within a specified deadline, an up-to-date declaration, as referred to in Article 125, paragraph 1 of the PZP, regarding non-exclusion and fulfilment of the conditions for participation in the procedure, prepared in accordance with the template of the standard form specified in the Commission Implementing Regulation (hereinafter: “JEDZ” or “single document”), in accordance with Annex 3 to the SWZ: 1) In part IV of the JEDZ form under the name “Qualification Criteria” the contractor may limit himself to completing section α, i.e. submitting a general declaration regarding all qualification criteria. In such a case, the contractor does not have to complete any of the remaining sections of part IV of the form regarding the qualification criteria, and the contracting authority will carry out the appropriate (evidentiary) verification of the fulfilment of the specific, defined by the contracting authority, conditions for participation in the procedure (selection criteria), based on the appropriate documents submitted by the contractor whose bid was most highly evaluated, at the request of the contracting authority (Article 126, paragraph 1 of the PZP). 2) In the case of contractors jointly applying for the award of the contract, each of these contractors submits a single document. These declarations confirm the absence of grounds for exclusion and the fulfilment of the conditions for participation in the procedure to the extent that each of the contractors demonstrates the fulfilment of the conditions for participation in the procedure. 3) The contractor indicates in the JEDZ form (Part II, Section C, D, Part IV, Section C, point 10) those parts of the contract that it intends to entrust to subcontractors (if applicable) together with the indication by the contractor of the subcontractor companies (if known). In the absence of indication by the contractor of the information in the specified scope, the contracting authority will assess that the contractor will perform the contract independently in full.
