Poland – Fuels – Zakup i dostawa oleju opałowego dla Miejskiego Przedsiębiorstwa Gospodarki Odpadami Sp. z o.o. w Sosnowcu.

1. The subject of the order covers the successive purchase and delivery of heating oil in a maximum quantity of 50,000 litres to the warehouse of the Buyer located in Sosnowiec at ul. Grenadierów 21. The Buyer guarantees the execution of the order in a quantity of at least 40,000 litres of heating oil, with the proviso that the quantity of ordered heating oil may not exceed the amount indicated in the contract as the maximum remuneration for the performance of the subject of the contract. 2. The heating oil will be delivered to a tank with a capacity of 5,000 litres, located on the premises of the Buyer's Plant. 3. The maximum quantity of heating oil covered by the order is 50,000 litres. The Buyer guarantees the purchase of at least 40,000 litres of heating oil, but up to the amount indicated in the contract as the maximum remuneration for the performance of the subject of the contract. The Buyer's non-utilisation of the maximum quantity of the order, i.e. the difference between 50,000 litres and the actual quantity of heating oil ordered, does not constitute a basis for claims by the Contractor, provided that the Buyer has realised the minimum guaranteed quantity of the order amounting to 40,000 litres. The Buyer reserves the right to limit the quantitative scope of the order also in the event of reaching the maximum contractual remuneration. No claims accrue to the Contractor on this account. 4. The offered heating oil must meet the parameters specified in the SWZ. 5. A detailed description can be found in Section II, Section 1 of the SWZ.
