Poland – Driving lessons – Przeprowadzenie kursu prawa jazdy kategorii B dla uczniów ponadpodstawowych szkół powiatu tarnogórskiego realizowanego w ramach projektu „MOBILNI ZAWODOWCY”

I.1. The subject of the contract is the service of conducting a driving course for category „B” for 280 Participants of the project being trained in secondary schools – 9 vocational schools and 1 art school in Tarnogórski County, participating in the project entitled „MOBILNI ZAWODOWCY”. 2. The participants of the project will be selected through recruitment from the following schools: 1) Technikum nr 5 in Wieloprofilowy Zespół Szkół in Tarnowskie Góry, 2) Technikum nr 12 in Zespół Szkół Techniczno-Usługowych in Tarnowskie Góry, 3) Technikum nr 7 in Zespół Szkół Artystyczno-Projektowych in Tarnowskie Góry, 4) Liceum Sztuk Plastycznych in Zespół Szkół Artystyczno-Projektowych in Tarnowskie Góry, 5) Technikum nr 2 in Zespół Szkół Budowlano-Architektonicznych in Tarnowskie Góry, 6) Technikum nr 9 in Centrum Edukacji Ekonomiczno-Handlowej in Tarnowskie Góry, 7) Technikum nr 6 in Zespół Szkół Gastronomiczno-Hotelarskich in Tarnowskie Góry, 8) Technikum nr 4 in Zespół Szkół Technicznych i Ogólnokształcących in Tarnowskie Góry. 3. The subject of the contract has been divided into 7 parts: 1) Part A: Conducting a driving course for category „B” for 40 Participants of the project „MOBILNI ZAWODOWCY”, 2) Part B: Conducting a driving course for category „B” for 40 Participants of the project „MOBILNI ZAWODOWCY”, 3) Part C: Conducting a driving course for category „B” for 40 Participants of the project „MOBILNI ZAWODOWCY”, 4) Part D: Conducting a driving course for category „B” for 40 Participants of the project „MOBILNI ZAWODOWCY”, 5) Part E: Conducting a driving course for category „B” for 40 Participants of the project „MOBILNI ZAWODOWCY”, 6) Part F: Conducting a driving course for category „B” for 40 Participants of the project „MOBILNI ZAWODOWCY”, 7) Part G: Conducting a driving course for category „B” for 40 Participants of the project „MOBILNI ZAWODOWCY”. 4. The Contractor may submit a bid for each part of the contract. 5. The subject of the contract is co-financed by the European Union under the European Funds for Silesia 2021-2027 (European Social Fund +) within the project „MOBILNI ZAWODOWCY”, Priority: FESL.06.00 – European Funds for education, Action: FESL.06.03 – Vocational training. 6. The detailed scope of the subject of the contract, the description of the requirements of the Purchaser in terms of implementation and acceptance specify: the description of the subject of the contract (Attachment No. 5 to SWZ) and the planned provisions of the contract (Attachment No. 3 to SWZ). 7. Requirements regarding the employment of persons under an employment contract (Article 95(1) of the Act): given that the activities carried out by persons during the implementation of the contract do not exhaust the concept of an employment relationship, the Purchaser does not foresee the requirement to employ persons under an employment contract. II.1. The procedure is conducted in the open tendering procedure in accordance with Article 132 of the Pzp. 2. The Purchaser does not foresee an electronic auction. III.1. The Purchaser envisages changes to the contract, in the scope of: 1) change in the amount of remuneration due to the Contractor, in the case of: change in the VAT rate or excise duty rate; the amount of the minimum wage or the minimum hourly rate set on the basis of the provisions of the Act on the minimum wage; the rules of social insurance or health insurance or the rate of contributions to social insurance or health insurance, the rules of accumulation and the amount of contributions to PPK, as referred to in the Act on PPK - if these changes will affect the costs of contract implementation by the Contractor. The change in remuneration will apply to the part of the contract subject not implemented, as of the date of entry into force of the above provisions; 2) change in the prices of materials or costs related to the implementation of the contract at a level amounting to at least 15% in relation to the prices of materials or costs applicable at the time of submission of the bid and maintained for a period of at least 3 months, where the initial period for determining the change in price is set as the date 6 months from the date of conclusion of the contract. Each subsequent valuation is permissible after the expiry of 3 months from the date of the previous valuation. The maximum permissible value of the change in remuneration due to the Contractor for the entire period of contract implementation is 7% of the amount specified in the Contractor's bid; 3) change in persons implementing the contract (specified in the bid) in the following cases: a) failure to fulfil obligations or improper performance, b) illness or other random events lasting at least 3 days, c) if the change becomes necessary for any other reasons independent of the Purchaser and the Contractor (e.g. resignation, termination of an employment contract). New persons implementing the contract must have experience not less than the experience of persons assessed in accordance with the bid evaluation criterion. In the case of implementation by the Contractor of several parts of the contract, a new person may not be indicated as a person implementing the contract in another part of the contract, for which the Contractor has a signed contract. 4) change in data such as the address of the registered office of both the Purchaser and the Contractor, in the event that such changes occur during the validity of the contract, 5) change in the contract implementation deadline caused by reasons beyond the control of the Contractor and the Purchaser, in particular the occurrence of a „force majeure”. The Purchaser understands the term „force majeure” to mean circumstances which, despite the exercise of due diligence, are unpredictable and which cannot be prevented or effectively countered, 6) change in the attachments to the contract, in particular templates and forms: attendance sheet, questionnaires, schedule of classes, 7) change in the number of participants and the number of students, if changes occur in the project during the validity of the contract. 2.
